97-22330 RESO RESOLUTION NO. 97-22330 A RESOLUTION OF THE MA VOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE CITY MANAGER, OR HIS DESIGNEE, TO SUBMIT AN APPLICATION ON BEHALF OF THE CITY OF MIAMI BEACH AND EXECUTE AN INTERLOCAL AGREEMENT WITH THE METROPOLITAN DADE COUNTY OFFICE OF AMERICANS WITH DISABILITIES ACT, FOR THE PURPOSE OF RECEIVING THE CITY'S FISCAL VEAR 1996-1997 GRANT AWARD IN THE AMOUNT OF $56,698; AUTHORIZING THE ACCEPTANCE OF THE GRANT; AND APPROPRIATING THE FUNDS IN COMPLIANCE WITH THE TERMS OF THE AGREEMENT. WHEREAS, in July 1990, the Americans with Disabilities Act (ADA) was passed by the U. S. Congress, and Title II of the ADA requires that state and local governments provide accessibility to th~ir programs and that they do not discriminate in the provision of employment, goods, services ald,Dr programs, on the basis of a person's disability; and WHEREAS, as required under Title II of the ADA, the City has developed a Transition j::>l<: n, which describes the facilities owned and/or controlled by the City and the architectural barriers ~)ulld in these facilities; and WHEREAS, the Metropolitan Dade County Office of ADA Coordination has funds availat,le :0 assist municipalities with their compliance with ADA requirements; and WHEREAS, funds to be received by the City under this grant may be used for modificatiolls 0 City facilities to remove architectural barriers, to train City employees with regard to the requirerr en:s of the ADA, to provide public awareness programs regarding the ADA, and to help fund the opera:ior s of the City's Office of ADA Coordination; and WHEREAS, the expenditure of the funds under this grant will be based on consultation witl1 tt e Mayor's Ad Hoc Barriers Free Environments Committee; and NOW THEREFORE, BE IT RESOLVED BV THE MA VOR AND CITY COMMISSION OF TH: CITY OF MIAMI BEACH, FLORIDA, that the City Manager, or His Designee, are hereby authorizE!d '0 submit an application on behalf of the City of Miami Beach and execute an Interlocaf Agreement with the Metropolitan Dade County Office of Americans with Disabilities Act, for the purpose of receivin~1 t~e City's Fiscal Year 1996-1997 grant award in the amount of $56,698; authorizing the acceptance o:t~e Grant; and appropriating the funds in compliance With" terms of the Agreement. ADMINISTRATION RECOMMENDATION Adopt the Resolution. BACKGROUND In July 1990, the Americans with Disabilities Act (ADA) was passed by the U.S. Congress. As required under Title II of the ADA, the City has developed; I Transition Plan, which describes the facilities owned and/or controlled by the City and thH architectural barriers found in these facilities. The Mayor's Ad Hoc Barriers Free Environme!nt ; Committee has taken a leadership role in the development of the Transition Plan. The funds to be received by the City under this grant may be used for modifications to City facililiei to remove architectural barriers, to train City employees in regards to the requirements of ADP, tl) provide public awareness programs regarding ADA, and to help fund the operations of the City' ; Office of ADA Coordination. The expenditure of the funds under this grant will be based 011 consultation with the Mayor's Ad Hoc Barriers Free Environments Committee. To comply with the law, the City has undertaken a program of modifying its facilities to remove architectural and communication barriers, and is reviewin~1 it: programs to develop ways of making them more accessible. The Administration proposes that this grant be applied for and accepted by the City so I hat architectural and communication barriers in City facilities, and inaccessibility to City programs r1a ' be remedied sooner than if these grant funds were not available to the City to assist in this eftort, Matching funds for the grant have been identified from those funds that the City is already spen<lin!1 in the removal of architectural and communication barriers and no new allocation of general f Jnd monies is expected as a result of this grant.
