Ordinance 1489 ORDINANCE NO. 1489
AN ORDINANCE AMENDING SECTION 34.35 AND
SECTION 34.36 OF "THE CODE OF THE CITY OF
MIAMI BEACH, FLORIDA, 1950".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Section 34.35 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby
amended to read as follows:
"Section 34.35 . Tax imposed; amount.
An excise or privilege tax in addition to all other
taxes of every kind imposed by law is hereby levied
and imposed upon the sale, receipt, purchase, posses-
sion, consumption, handling, distribution and use of
cigarettes in the territorial limits of the City, for
cigarettes of standard dimensions as defined by the
general law of the State, in the following amounts:
1. (a) Upon all cigarettes, three and one-half
inches long or less, four mills on each
cigarette;
(b) Upon all cigarettes, between three and
one-half and six inches long, eight mills
on each cigarette; and
(c) Upon all cigarettes, six inches long or
longer, sixteen mills on each cigarette.
2. The description of cigarettes contained in sub-
section 1 of this section are hereby declared
to be standard as to dimensions for taxing pur-
poses as provided in this article and should any
cigarette be received, purchased, possessed, sold,
offered for sale, given away or used of a size
other than of standard dimensional the same shall
be taxed at the rate of one cent on each such
cigarette.
3. Where cigarettes, as described in subsection 1 (a)
above, are packed in varying quantities of twenty
cigarettes or less, the following rates shall
govern:
(a) Packages containing ten cigarettes or less
require a four cent tax; and
(b) Packages containing more than ten but not
more than twenty cigarettes require an
eight cent tax.
4. Where cigarettes, as described in subsection 1 (b)
above, are packed in varying quantities of twenty
cigarettes or less, the following rates shall
govern:

(a) Packages containing ten cigarettes or
less require an eight cent tax; and
(b) Packages containing more than ten but
not more than twenty cigarettes require
a sixteen cent tax.
5 . Where cigarettes, as described in subsection 1
(c) above, are packed in varying quantities of
twenty cigarettes or less, the following rates
shall. govern:
(a) Packages containing ten cigarettes or
less require a sixteen cent tax; and
(b) Packages containing more than ten but
not more than twenty cigarettes require
a thirty-two cent tax. "
SECTION 2: That Section 34.36 of "The Code of the City of Miami
Beach, Florida, 1950" be and the same is hereby
amended to read as follows:
"Section 34.36. Collection.
The tax levied and imposed herein shall be collected
in the manner prescribed in Section 210.03, Florida
Statutes. "
SECTION 3 : This ordinance shale_ take effect on July 1, 1963 .
SECTION 4: All ordinances or parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 5 : The health and welfare of the City being in peril,
the three readings of this ordinance shall be had
in one session and the City Council finding that this ordinance
is necessary for the immediate protection of its citizens, it
shall therefore go into effect immediately upon its passage.

days in accordance with the requirements of the City
Charter of the said City of Miami Beach.
