AN ORDINANCE AMENDING ORDINANCE 140. 289,
BEING THE COMPREHENSIVE ZONING ORDINANCE
OF THE CITY OF MIAMI BEACH, FLORIDA.
WHEREAS, the City Council of the City of Miami Beach
heretofore adopted Ordinance No. 1464 creating Height District
No. 5, and included in said District that certain area of the
City of Miami Beach lying South of Lincoln Road, East of
Biscayne Bay; West of the Atlantic Ocean and South to Government
Cut, and
WHEREAS, said Ordinance limited all structures in said
Height District to a maximum height of eight (8) stories, and
WHEREAS, the purpose and object of said Ordinance was to
implement and effectuate the objects and purposes set forth in
the Zoning Enabling Act of the City of Miami Beach including
the provision of adequate light and air, and to prevent the
overcrowding of land, and
WHEREAS, following a public hearing duly held to consider
the adoption of this amendment to the City's comprehensive
Zoning Ordinance, and
WHEREAS, the City Council has now determined that the
general welfare of the City and its inhabitants requires the
existence and establishment of a hospital in excess of eight
stories in height in said Height District No. 5, and
WHEREAS, it is unlikely that more than one such hospital
will hereafter be constructed in said District, and approval
thereof by way of variance would be appropriate, were such
procedure in conformity with legal principles applicable to
zoning, and
WHEREAS, the construction of such hospital will not
militate against the objectives sought by said Ordinance
No. 1464 including provisions for adequate light and air,
NOW, THEREFORE, BE IT HEREBY ORDAINED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1: That that portion of Section 16-C of Ordinance
No. 289, reading as follows:
"Height District No. 5. In Height District
No. 5, no building shall be erected, con-
structed, reconstructed or structurally al-
tered in excess of eight (8) stories in
height or in excess of ninety (90) feet in
height above grade, and shall conform to
all of the requirements set forth in other
sections of this ordinance, and shall comply
with all the requirements of the Building
Code of the City of Miami Beach, Florida.

or intended to be used for habitation,
storage and bulkheads not exceeding in
combined area 15/ of the roof area of
the building, may be added to such build-
ings, provided that such additions shall
not exceed twenty (20) feet in height .
Height District No. 5 shall include all
parcels of land in that area of the City
of Miami Beach bounded on the north by the
southerly line of Lincoln Road, on the west
by Biscayne Bay and on the south by Government
Cut and on the east by the Atlantic Ocean. "
be and the same is hereby amended to read as follows:
"Height District No. 5 . In Height District

height or in excess of ninety (90) feet in
height above grade, and shall conform to
all of the requirements set forth in other
sections of this ordinance, and shall comply
with all the requirements of the Building
Code of the City of Miami Beach, Florida.

further, however, that notwithstanding any-
thing herein contained, hospitals may be
erected and constructed to a maximum height
of fourteen (14) stories, or one hundred
and sixty (160) feet above grade, exclusive
of the additions authorized hereby not ex-
ceeding twenty (20) feet in height .
Height District No. 5 shall include all
parcels of land in that area of the City
of Miami Beach bounded on the north by the
southerly line of Lincoln Road, on the west
by Biscayne Bay and on the south by Government
Cut and on the east by the Atlantic Ocean. "
SECTION 2: All ordinances in conflict herewith be and the same
are hereby repealed.
SECTION 3 : This ordinance shall go into effect immediately upon
its passage and posting as required by law.
