A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF
THE CITY OF MIAMI BEACH, FLORIDA, PURSUANT TO
SECTION 82-93(a), OF THE CITY CODE, SETTING A PUBLIC
HEARING FOR JUNE 7, 2017, TO CONSIDER APPROVING A
REVOCABLE PERMIT REQUEST BY PPF 723 LINCOLN LANE
NORTH, LLC, IN ORDER TO ALLOW THE INSTALLATION OF
(1) A 15 SQUARE FOOT TENANT SIGN ON THE WEST
FACADE OF THE BUILDING LOCATED AT 723 LINCOLN
LANE NORTH, TO EXTEND APPROXIMATELY TWO (2) FEET
INTO MERIDIAN AVENUE, (2) A 48 SQUARE FOOT TENANT
SIGN ON THE WEST FACADE OF THE BUILDING TO EXTEND
APPROXIMATELY THREE (3) FEET INTO MERIDIAN AVENUE;
AND (3) A PEDESTRIAN CANOPY ON THE SOUTH FACADE
OF THE BUILDING TO EXTEND APPROXIMATELY 8'11"
OVER LINCOLN LANE NORTH.
WHEREAS, PPF 723 Lincoln Lane, LLC (Applicant) is the owner of the building, located
at 723 Lincoln Lane North, and is requesting a revocable permit for the installation of: (1) a 15
square foot tenant sign on the west façade of the building, which sign is to extend approximately
two (2) feet into the public right-of-way, Meridian Avenue; (2) a 48 square foot tenant sign on the
west façade of the building, which sign is to extend approximately three (3) feet into the public
right-of-way, Meridian Avenue; and (3) a pedestrian canopy on the south façade extending
approximately eight feet eleven inches (8'11") over the public right-of-way, Lincoln Lane North;
and
WHEREAS, on May 3, 2016, the City's Design Review Board (DRB) has approved the
design for the both the signs and the canopy through the final Order issued under File No.
23076; and
WHEREAS, the Applicant is requesting to encroach into the public rights-of-way and has
applied for a revocable permit to allow the first sign to be installed at an elevation of 15 feet
above finished floor elevation; the second sign to be installed at an elevation of 48 feet above
finish floor elevation; and for the canopy to travel along Lincoln Lane North for approximately
205 feet, at a width of 12 feet, and a clearance of approximately 15 feet above the sidewalk; and
WHEREAS, pursuant to Section 82-93(a) of the City Code, the City Commission desires
to schedule the public hearing to consider the request for a revocable permit; and
WHEREAS, the Administration recommends scheduling of the public hearing.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND CITY COMMISSION
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission, pursuant to
Section 82-93(a), of the City Code, setting a public hearing for June 7, 2017, to consider
approving a revocable permit request by PPF 723 Lincoln Lane North, LLC, in order to allow the
installation of (1) a 15 square foot tenant sign on the west façade of the building located at 723
Lincoln Lane North, to extend approximately two (2) feet into Meridian Avenue, (2) a 48 square
foot tenant sign on the west façade of the building to extend approximately three (3) feet into
Meridian Avenue; and (3) a pedestrian canopy on the south façade of the building to extend
approximately 8'11" over Lincoln Lane North.

RECOMMENDATION
The Administration recommends that the Mayor and City Commission approve the Resolution setting
a Public Hearing for this revocable permit.
ANALYSIS
PPF 723 Lincoln Lane, LLC (Applicant) is the owner of the building, located at 723 Lincoln
Lane North, and is requesting a revocable permit for the installation of a 15 square foot tenant
sign on the west façade extending approximately two (2) feet into the right of way, a 48 square
foot tenant sign on the west facade extending approximately three (3)feet over the right of way,
and a pedestrian canopy on the south facade extending approximately eight feet eleven inches
(8'11") over the adjacent public sidewalk.
The City's Design Review Board (DRB) has approved the design for the both the signs and the
canopy through final Order File No. 23076 approved on May 3, 2016.
The Applicant is proposing the introduction of the 15 square foot projecting sign with bottom
elevation approximately 15 feet above finished floor elevation, a 48 square foot projecting sign
with bottom elevation approximately 48 feet above finish floor elevation, and a canopy
measuring approximately 205 feet long and 12 feet wide with the clearance of approximately 15
feet above the sidewalk. The improvements being proposed by the Applicant will increase the

value of the Property and in turn the neighborhood. Granting the revocable permit will not confer
any special privilege upon the Applicant.
Pursuant to Section 82-93(a) of the City Code, if the City Commission approves the Resolution
on First Reading, a public hearing will be scheduled to consider the request for a revocable
permit and; additionally, in accordance with Section 82-93(b) of the City Code, notice of the
public hearing will be mailed to owners of land lying within 375 feet of the existing permit area.
At the public hearing, the revocable permit application will be reviewed pursuant to Section 82-
94, of the City Code.
The City Code provides the ability to obtain a revocable permit for the encroachment of the
historic canopy into the right of way. The Applicant satisfies the revocable permit criteria stated
in Section 82-94 of the City Code ad follows:
• The Applicant's need is substantial.
The Applicant respectfully requests the revocable permit in order to comply with the conditions
of the DRB Order No. 23076. The revocable permit will allow the Property to maintain
compliance with this development approval, make the building usable for retail tenant and
desirable for visitors by shading the sidewalk and shielding it from rain.
• The Applicant holds title to an abutting property.
The Applicant owns the Property.
• The proposed improvements will comply with applicable codes, ordinances, regulations,
neighborhood plans and laws.
The proposed canopy will comply with applicable codes, ordinances, regulations, neighborhood
plans and laws.
• The grant of the application will have no adverse effect on governmental/utility easements and
uses on the property.
The canopy will be installed at an appropriate height with 15 foot clearance, which permits free
pedestrian passage below the canopy and does not obstruct the right-of-way. The canopy will
have no adverse effect on governmental/utility easements on the property.
• That the grant of the revocable permit will enhance the neighborhood and/or community by
such amenities as, for example, enhanced landscaping, improved drainage, improved lighting,
and improved security.
The proposed canopy will promote pedestrianism in the area. The introduction of the canopy
will increase the value of the Property, and in turn that of the neighborhood. Furthermore, it will
be desirable to visitors by shading the sidewalk and shielding it from rain.
• That granting the revocable permit requested will not confer on the applicant any special
privilege that is denies by this article to other owner of land, structures or buildings subject to
similar conditions located in the same zoning district.
Granting the revocable permit will not confer any special privilege upon the Applicant. Any
property owner within the City of Miami Beach can apply for a revocable permit, provided that
the application meets the criteria stated in the Code does not interfere with the utilization of
public property, and enhances the community.

• That granting the revocable permit will not devalue any of the adjacent properties and will not
have a detrimental effect on the public welfare. In fact it will improve the historic character of the
property and the surrounding area.

CONCLUSION
The Administration recommends that the Mayor and City Commission approve the Resolution
setting a Public Hearing for this revocable permit.
