SUBJECT: Planning Board Recommendation Pertaining to Non-Conforming_._F_£A:>_<R~---------
On March 7, 2017, the Mayors Blue Ribbon Panel on Sea Level Rise discussed a proposed
ordinance amendment pertaining to Non-Conforming Buildings. As part of this discussion, the
Blue Ribbon Panel recommended that the City Commission refer a separate discussion item to
the Planning Board, pertaining to Legal Non-Conforming FAR, and for the Planning Board to
make a recommendation.
On April 26, 2017, at the request of Commissioner John Elizabeth Aleman, the City Commission
referred the recommendation of the Mayors Blue Ribbon Panel on Sea Level Rise to the
Planning Board to further discuss the item and provide a recommendation.
On May 23, 2017, the Planning Board discussed the referred item and recommended that the
City Commission discuss and consider a potential ballot question for the following:
1. A code amendment to allow for the movement of legal non-conforming FAR within a
building.
2. A code amendment to address the re-purposing of existing required parking and the legal
non-conforming FAR created.
The Administration recommends that the City Commission consider the above noted
recommendation of the Planning Board and provide appropriate policy direction.
