ORDINANCE NO. 1572

AN ORDINANCE �NlENDING CHAPTER 2 OF THE CODE
OF THE CITY OF MIAMI BEACH, FLORIDA BY ADD-
ING NEW SECTIONS THERETO TO BE NUMBERED
SECTIONS 2A-55 TO 2A-56 AND REL�sTING TO
CONTRACTUAL RELATIONSHIPS BETWEEN THE CITY
OF MSAMI BEACH AND PARTIES REFUSING TO
WAIVE IMMUNITY FROM PROSECUTION.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Chapter 2 of the Code of the City of Miami
Beach, Florida be and the same is hereby amended by
adding new sections thereto to be numbered and to read as
follows:
"SECTION 2A-55: No officer of the City of
Miami Beach, its departments,
subdivisions or agencies shall knowingly en-
ter into or execute any contract of whatsoever
nature, whether pertaining to employment, ser-
vices or for the purchase or rental of any
product or facility, for or on behalf of the
City, its departments, subdivisions or agencies
with any person, as defined in Section 1.2 of
the Code of the City of Miami Beach who having
had prior contractual relationships with the
City, its departments, subdivisions or agen-
cies, and in matters pertaining to the conduct
and exercise of such contractual relationship
and dealings with the City, or any of its
officers or employees, has refused to waive
immunity from prosecution before any Grand
Jury, or other body, officer or officers hav-
ing the rights and possessing the powers of a
Grand Jury. Al1 persons violating the provi-
sions of this Section may be removed from
office or employment, and all such contracts
shall be deemed null and void."
"SECTION 2A-56: In the event that any person
after having entered into any
contract with the City of Miami Beach, its de-
partments, subdivisions or agencies, and dur-
i.ng the existence of such contractual rela-
tionship, shall, in matters pertaining to the
conduct and exercise of his said contractual
relationship with the City or any of its
officers, employees or elected officials, re-
fuse to waive immunity from prosecution before
any Grand Jury or any other body, officer or
officers having the rights and possessing the
powers of a Grand �'ury then, in such event,

such contract shall be held and deemed to be
null and void from its inception and the City
shall be relieved of all obligation thereunder."
SECTION 2: All ordinances Qr parts of ordinances in conflict
herewith be and the same are hereby repealed.
SECTION 3: '�his ordinance shall go into effect immediately
upon its passage and posting as required by law.
