BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FL4RIDA:
SECTION 1: That Section 5.1i of Ordinarice No. 845 reading as
follows :
"Sec. 5.11 Notwithstanding any provisions of this
Ordinance, any Department Head or other
Unclassified Employee as defined in the Civil Service
Act, who is a Member of this System, and who has to
his credit �en (10) or more years of Cr�ditable Ser-
vice, shall be eligible for Service Retirement bene-
fits if he shall be involuntarily separated from ser-
vice for reasons other than misconduct, misfeasance
or malfeasance; pro�rided that no Retirement Allawance
shall be commenced under this Section until such time
as the person so eligible for Retirement benefits
shall reach the age at which he would otherwise have
been eligible ta receive benefits. No person having
an unexpired Leave of Absence from a positi.on in the
Classified Service of the City shall be eligible
under this Section."
be and the same is hereby amended to read as follows:

from service with the City of Miami Beach and who
does not accept a separation refund will be entitled
to a deferred Retirement Allowance; provided that no
Retirement Allowance shall be comt�r�enced under this
Section until �uch time as the person so eligible for
Retirement benefits shall reach the age at which he
would otherwise have been eligible to receive benEfits.
No person having an unexpired Leave of Abserice shall

SECTIC3N 2: That Section 5A.08 of Ordinance No. 845 reading as
follows :

or more years of Creditable Service, and
any Employee Member who has f i�re ( 5) or more years of

the age at which he would be eligible for retirement
who separates, or is separated, from service with the
City of Miami Beach and who does not accept a separa-
tiori refund will be entitled to a deferred Retirement
Allowance, payment of which will comr.�ence at the age
the Member would be eligible for retirement with his
number of years of Creditable Service. Such deferred
Retirement Allowance will be computed as provided in
Sub-sectian 5A.03.44 hereof."

SECTION 3: That Section 5.12 of Ordinance No. 845 be and the
same i.s hereby d�leted.
SECTION 4; That Sections 5.13 and 5.14 of Ordinance No. 845 be
and thQ �ame are hereby renumbered 5.12 and 5.13
resgectively.
SECTION 5: That all ordinances or parts of ordinances in con-
flict herewith be and the same are hereby repealed.

SECTI�N 6: The provisions of this Ordinance shall become
effective on the 7th day of June, 1967, provided it
shall be approved by a majority of the qualified voters of the
City of Miami Beach, Florida, voting on the same at an election
called for that purpose.

MENT SYSTEM FOR CERTAIN EMPLOYEES OF THE CITY OF MIAMI BEACH, FLORIDA"'
having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has been posted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hail in said City on the 19th day of April, 1967
and that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City Charter
of the said City of Miami Beach.
