AN ORDINANCE AMENDiNG ORDINANCE N0. 289, COMMONtY
KN04�!N AS THE "ZONING ORDINANCE OF THE ClTY OF MtAMi
6EACH, FLORiDA"
BE IT OROAjNED BY THE CITY COUNCIL OF THE CITY OF MIAM! BEACH, FLORiDA:
SECTtON 1. Thafi Section 2i of Ordinance No. 209, commonly known as the
"Zoning Ordinance of City o� h'tiami Bea�h, Florida and the
s�me is her-eby amended, by adding the following paragrap�i thereto, to wit:

"Upon tfie withdrawa� or final deniai of an application for a
change of zoning or other amendment to this ordinance, no new
application-�ay be filed for such change of zoning or other
amendment to this ordinance within one (1) year following such
withdrawai or denial, unless, however, the decision of the City
Council or the Board taki�g any such f-inal action is made without
prejudice, or unless the withdrawal of such application is per-
mitted fio be made without prejudice. An appiication may be
withdrawn without prejudice by the applicant as a matter of right,
if such request is signed by the applicant and filed with the
City Clerk and Finance Direcfior prior to the giving �f any notice
reyuired by this ordinance; otherwise, ail such reyuests for
withdrawal shall be with prejudice, save and except thafi the
Zoning Board of Adjustmenfi or the City Council may permit with-
drawals without prejudice at the time the application is con-
sidered by the said Board or said City Council; provided furfiher,
that no application may be withdrawn after finai action has been
taken."
SECTION 2. That Section 2l of Ordinan�e No. 289, commonly known as the "Zoning
Ordinance of City of Miami Beach, Florida" be and the same is
hereby amended, by adding the foiiowing paragraph thereto, to wit:
"Upon the withdrawai or final denial of an application for a
variance from the provisions of this ordinance, no new application
may be fited for such variance wifihin six (b) months following
such withdrawal or denial, unless, however, t�e decision of the
2oning Board of Adjustment taking any such final action is made
without prejudice, or unless the withdrawal of such application is
permitted to be made without prejudice. An application may be
withdrawn without prejudice by the applicant as a matter of right,
if such rec�uest is signed by the applicant and filed with the
E� ar.� i ng and bn ing�D i rector p r i or to the g i v i ng of any not i ce re-
yuired by this ordinance; otherwisE, all such reyuests for with-
drawal shail be with prejudice, save and except that the Zoning
Board of Adjustment may permit withdrawals without prejudice at the
time the applicatian for said variance is considered by the said
Board; provided further, that no application may be withdrawn after
final action has been taken."

SECTtOR� 3. That all ordinances or parts of ordinances in conflict herewith
be and the same are hereby repealed.
SECTION 4. That this ordinance shall go into effect immediately upon iCs
passage and posting as rer�uired by law.
