PROVIDING FOR THE REFUND OF A PORTION OF
ANY LICENSE TAX PAID THEREUNDER UNDER
CERTAIN CONDITIONS.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDI:
SECTION 1: That Section 4 of Ordinance No. 394 of the City
of Miami Beach, Florida, be amended so as to read
as follows:
"Section 1. All licenses shall be payable on or
before the first day of November of each year and no license
shall be issued for any fractional portion of a year, provided,
however, that those operating businesses or occupations covered
by this Ordinance rho establish permanent places of business
in the City of Miami Beach after July 1st may obtain a license
for the remaining portion of the fiscal year upon the payment
of one-half the fee provided for in this Ordinance, provided
further, if any occupation or business theretofore lawfully
carried on or lawful to be carried on in the City of Miami Beach
shall have been heretofore or shall hereafter at any time be
prohibited and made unlawful by any Ordinance of the City of
Miami Beach, then the City Clerk shall, upon application for
license by or for any such business or occupation, issue a
license for the fractionalpart of the year from November first,
of the year during which application shall be made to the
effective date of such Ordinance, if such effective date falls
between November first of such year and October thirty-first of
the succeeding calendar year, and shall collect that proportion
of the license tax for such occupation or business which shall
bear the same relation to the total license tax for a whole year
for such occupation or business as the fractional period for
which license is issued shall bear to an entire license year,
and in the event a license tax for the period of a whole year
shall have been or shall hereafter be collected from any person
Those occupation or business has been or shall thereafter have
been so prohibited and made unlawful as of a date during such
year for which license tax has been collected, the City Clerk
is hereby authorized to retain such part of the license tax so
collected as shall bear to the total amount so collected the
same relation as the period from November first of the year of
the license so issued to the effective date of such prohibitory
Ordinance shall bear to the entire license year of twelve months,
and is hereby authorized to refund the balance thereof to the
person who shall have paid the same, and upon making such refund
the City Clerk shall require the production of such license and
shall endorse thereon the effective date of such prohibiting
Ordinance as the expiration date of such license . it

BY PROVIDING FOR THE ISSUANCE OF LICENSES THEREUNDER FOR A
FRACTIONAL PART OF THE FISCAL YEAR UNDER CERTAIN CONDITIONS
SET FORTH THEREIN AND PROVIDING FOR -THE REFUND OF A PORTION
OF ANY LICENSE TAX PAID THEREUNDER UNDER CERTAIN CONDITIONS",
having been duly passed and adopted by the City Council of
the City of Miami Beach, Florida, has been posted by me in
three conspicuous places in the City of Miami Beach, one of
which was at the door of the City Hall in said City on the
5th day of November, A. D., 1936, and that said Ordinance
remained posted for a period of at least thirty day s in
accordance with the requirements of the City Charter of the
of the said City of Miami Beach.
