2017-29904 Reso RESOLUTION NO. 2017-29904 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, APPROVING AND AUTHORIZING THE CITY TO ACCEPT A SPONSORSHIP FROM BOUCHER BROTHERS MIAMI BEACH, LLC, FOR TABLES, CHAIRS, AND UMBRELLAS (BRANDED WITH THE BOUCHER BROTHERS LOGO), INCLUDING DAILY SET UP AND TAKE DOWN SERVICE, TO BE USED EXCLUSIVELY IN CONNECTION WITH THE CITY'S PLANNED RUE VENDOME "SOFT" STREET CLOSURE BETWEEN 71ST STREET AND NORMANDY DRIVE; AND FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A SPONSORSHIP AGREEMENT. WHEREAS, each year, the City of Miami Beach hosts a wide range of events and programs throughout Miami Beach, in order to engage and educate the community, and to provide opportunities for improved mobility and active use of outdoor recreation space; and WHEREAS, the North Beach Blue Ribbon Committee recommended the closure of Rue Vendome, including the development of safe, comfortable and attractive outdoor seating, to allow a connection between the commercial establishments on the west side of Rue Vendome and the Normandy Isle Monument Park, to help drive the economic development in North Beach; and WHEREAS, the recommendation of the North Beach Blue Ribbon Committee was later adopted as part of the North Beach Master Plan; and WHEREAS, at its March 1, 2017 meeting, the City Commission adopted Resolution No. 2017-29776, approving the permanent closure of Rue Vendome, between 71st Street and Normandy Drive, following a three-month "soft closure" (the "Soft Closure Period"), in accordance with the North Beach Master Plan and subject to final funding approval of the Rue Vendome Public Plaza Capital Project in the City's budget; directing the City Administration to report back to the City Commission following the three-month soft closure; and further authorizing the City Administration to proceed with an expedited survey of the area to be made available to area businesses; and WHEREAS, Boucher Brothers Miami Beach, LLC ("Boucher Brothers") has offered to sponsor tables, chairs, and umbrellas, including daily set-up and take-down, at no cost to the City, for use on Rue Vendome during the Soft Closure Period; and WHEREAS, Rue Vendome, with the sponsored street furniture would be available for general public use at no charge; and WHEREAS, City staff has worked diligently to identify sponsorships to offset the costs of implementing the proposed urban design improvements for safe and comfortable pedestrian use during the Soft Closure Period; and WHEREAS, the Administration is aware that the umbrellas will be branded with the business logo of the Boucher Brothers organization; and WHEREAS, the Administration recommends that the Mayor and City Commission approve and authorize a sponsorship with Boucher Brothers for tables, chairs, and umbrellas for use exclusively during the Soft Closure Period. NOW, THEREFORE, BE IT DULY RESOLVED BY TH f E MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission hereby approve and authorize the City to accept a sponsorship from Boucher Brothers Miami Beach, LLC, for tables, chairs, and umbrellas (branded with the Boucher Brothers logo), including daily set-up and take-down service, to be used exclusively in connection with the City's planned Rue Vendome "Soft" Street Closure between 71st Street and Normandy Drive; and further authorize the City Manager to execute a sponsorship agreement. RECOMMENDATION The Administration recommends that the Mayor and City Commission approve the Resolution. BACKGROUND At the March 1, 2017 meeting, the City Commission passed a motion approving the permanent closure, preceded by a three (3)-month "soft closure", of Rue Vendome between 71st Street and Normandy Drive. The Commission directed the Administration to conduct a survey of the area at the City's expense, to make the survey available to business owners that want to pursue a sidewalk café permit, and suggested that the Administration notify the residents and businesses in the area prior to implementation of the soft closure. The permanent closure of Rue Vendome was developed by the North Beach Blue Ribbon Committee and later approved as part of the North Beach Master Plan. The permanent closure has also been approved by the Florida Department of Transportation and Miami-Dade County Department of Transportation and Public Works. A community meeting was held on April 5, 2017 to update the local residents and businesses on the pending street closure. At the meeting, various concepts for a soft closure as well as a permanent closure were presented to the community for input. ANALYSIS As a result of coordination efforts by Staff, in search of temporary street furniture with shading (umbrellas) for placement on Rue Vendome, Boucher Brothers Miami Beach, LLC offered Page 1376 of 1511 to sponsor tables, chairs, and umbrellas on a temporary basis, during the three (3)-month soft closure of Rue Vendome between 71st Street and Normandy Drive. The umbrellas will display the Boucher Brothers logo. The sponsorship requires a resolution of the Mayor and Commission to authorize the City Manager to accept the street furniture from Boucher Brothers Miami Beach, LLC, for use exclusively as part of the City's soft closure of Rue Vendome between 71st Street and Normandy Drive. Boucher Brothers will commit to setting-up and taking-down the sponsored street furniture on a daily basis for the duration of the three (3)-month soft closure. Should the City Commission approve this resolution, execution of a sponsorship agreement between the City and Boucher Brothers Miami Beach, LLC will be required.
