98-22853 RESO RESOLUTION NO. 98-22853 A RESOLUTION OF THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, AUTHORIZING THE ADMINISTRATION TO ENTER INTO NEGOTIATIONS FOR A TWO-YEAR CONTRACT WITH MONTENAY POWER CORPORATION, PURSUANT TO REQUEST FOR PROPOSALS (RFP) NO. 53-97/99, FOR PROVIDING RESIDENTIAL SOLID WASTE AND YARD TRASH COLLECTION AND DISPOSAL; AND IF NEGOTIATIONS ARE NOT SUCCESSFUL, AUTHORIZE NEGOTIATIONS WITH WASTE MANAGEMENT, INC. OF FLORIDA. WHEREAS, the City issued a Request for Proposals (RFP) No. 53-97/99 for providing residential solid waste and yard trash collection and disposal; and WHEREAS, twenty-six (26) specifications for RFP No. 53-97/99 were issued, resulting in seven (7) timely responses; and WHEREAS, an Evaluation Committee recommended by the City Manager and approved by the Mayor and City Commission met on July 7, 1998; and WHEREAS, the Evaluation Committee unanimously voted to recommend Waste Management, Inc. of Florida as the top-ranked firm and BFI Waste Systems of North America, Inc. as the second-ranked firm; and the City Manager concurred with this recommendation; and WHEREAS, the Mayor and City Commission has reviewed the recommendations of the City Manager and the Evaluation Committee and rejects said recommendations, and would further authorize the Administration to enter into negotiations for a two-year contract with Montenay Power Corporation, and if negotiations are not successful, authorize negotiations with the second lowest bidder Waste Management, Inc. of Florida. NOW, THEREFORE, BE IT DULY RESOLVED BY THE MAYOR AND CITY COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and City Commission herein authorize the Administration to enter into negotiations for a two-year contract with Montenay Power Corporation, pursuant to Request For Proposal (RFP) No. 53-97/99, for providing residential solid waste and yard trash collection and disposal; and if negotiations are not successful, authorize negotiations with Waste Management, Inc. of Florida. Kasdin and Members of the City C ission DATE: July 15, 1998 FROM: Sergio Rodriguez City Manager SUBJECT: A Resolutio of the Mayor and City Commission of the City of Miami Beach, Florida, Accepting the Ranking of Responses Received and Authorizing the Administration to Enter into Negotiations for a Two-Year Contract with the Top-Ranked Firm of Waste Management, Inc. of Florida, Pursuant to Request for Proposals (RFP) No. 53-97/99 for Providing Residential Solid Waste and Yard Trash Collection and Disposal; and if Negotiations Are Not Successful, to Negotiate with the Second-Ranked Firm of BFI Waste Systems of North America, Inc. ADMINISTRATION RECOMMENDATION: Adopt the Resolution. FUNDING: Funding is available from Sanitation Department Budget Account No. 435,0430.000334. BACKGROUND: The City of Miami Beach currently contracts with Browning-Ferris Industries (BFI) for these services at a rate of $15.84 per residential unit per month, pursuant to RFP No. 63-96/98, The residential service agreement is due to expire October 18, 1998, and the City has the option to renew the agreement until April!3, 2000. Written notice of such renewal must be given to BFI at least sixty (60) days prior to the end of the initial term. Additionally, the City has the option of canceling the agreement with thirty (30) days written notice to the contractor. At its meeting of May 6, 1998, the City Commission authorized the issuance of an RFP for residential solid waste and yard trash collection and disposal. RFP No. 53-97/99 was issued on May 8, 1998, with twenty-six (26) specifications being mailed. A pre-proposal meeting was held on May 19, 1998, and representatives of eight firms attended. Amendment No.1 was issued on May 28, 1998, changing the deadline for proposals to June 18, 1998, answering questions from prospective proposers, and adding the operation of the Stash Area located at 28th Street and Meridian Avenue to the scope of services, Amendment No.2 was issued on June 12, 1998, responding to additional questions from prospective proposers. Michele Puldy-Burger, resident of Miami Beach Ronnie Singer, Executive Assistant to the City Manager, Miami Beach Robert Thomas, Director, Sanitation Department, Miami Beach RFP No. 53-97/99 Page Three July 15, 1998 ANALYSIS: The Evaluation Committee met on July 7, 1998, and each proposal was evaluated in accordance with the criteria listed in the Request for Proposals: Cost to the City. Ability to provide high-quality service to the City's residents, as evidenced by type and amount of equipment, personnel, and procedures. Prior experience in the industry, and prior service to City or to other groups of residents in a high-quality manner. , Financial condition and stability of the proposer, and financial outlook for the proposer for the term of the contract. A motion was made, and unanimously accepted, to eliminate the three proposers with the highest prices from further consideration. Those firms were Clean- Tec Waste Services, Kimmins Recycling Corp., and All Services Refuse. Upon further discussion it was also determined that Eastern Environmental Services, Inc. would not be given further consideration based on the firm providing only one local reference, the City of Hollywood, which reported problems with the firm paying for damage of public/private property and with missed pick-ups. Several committee members voiced their concern about Montenay Power Corporation, which proposed the lowest cost to the City, not having any experience in residential pick-up in the United States. Montenay Power Corporation is part of the VIVENDI group, a Paris-based group whose stock is publicly traded on the Paris stock exchange. Its parent company, CGEA, is the umbrella organization for solid waste activities worldwide, and is the largest solid waste management company in the United Kingdom and France. While Montenay expressed an interest in the City's RFP as "a strategically important opportunity to provide 'showcase' quality service" to Miami Beach, committee members expressed a fear of being a "test site" for this firm. The committee unanimously agreed to recommend Waste Management, Inc. of Florida as the top- ranked firm, based on its price proposal, its local experience, its excellent references, and its financial strength. Additionally, the committee agreed that if negotiations with Waste Management are not successful, to recommend BFI Waste Systems of North America, Inc. as the second-ranked firm. RFP No. 53-97/99 Page Four July 15, 1998 ANAL YSIS: (Continued) If this agreement is awarded to Waste Management at the proposed prices, the City will realize a savings of over $230,000 yearly when compared to the current prices ($15.84/mo.) paid to BFI for residential pick-ups, and approximately $200,000 yearly for the operation of the Stash Site. The savings to the City are more than $250,000 yearly when comparing Waste Management's proposed prices to BFI's proposed prices in response to this RFP, which includes the operation of the Stash Site. In accordance with the terms of the RFP, the City Manager has reviewed the Evaluation Committee's recommendation and concurs with its ranking of proposals. CONCLUSION: The Mayor and Commission should accept the ranking recommended by the City Manager, and authorize the Administration to negotiate a contract with the top-ranked firm of Waste Management, Inc. of Florida; and if negotiations are not successful, authorize negotiations with the second-ranked firm ofBFI Waste Systems of North America, Inc.
