RESOLUTION NO. 13203
WHEREAS, the City Council of the City of Miami
Beach, Florida, has duly found and determined that an
emergency exists within the City affecting the present and
future needs, the health, safety, morals, order, convenience,
prosperity, and general welfare of the citizens of the City
of Miami Beach; and to provide for efficiency and economy
in the process of development, for the appropriate and best
use of land, for preservation, protection, development and
conservation of the natural resources of land, water and
air, for convenience of traffic and circulation of people
and goods, for the use and occupancy of buildings, for
public utilities and facilities, for promotion of the civic
amenities of beauty and visual interest, and for development
in accord with a Comprehensive Development Plan being
considered by the City Council by establishing zoning
districts and by regulating the location and use of buildings,
signs and other structures, water and land for commerce,
industry and residence, and by regulating and limiting or
determining the height, bulk, and access to light and air of
buildings and structures, the area of yards and other open
spaces and the density of use;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that upon the
adoption of this Resolution, no building permit shall
thereafter be issued by the City of Miami Beach, Florida,
for a period of ninety (90) days, provided, however, that
nothing herein contained shall be applicable to construction
presently in progress under duly issued permit; or to any
plans now being processed by the City' s Building Department,
pursuant to an existing application for a building permit,
or to any proposed construction of the 200 unit Low Rent
Public Housing to be constructed on city owned land, on the
west side of Alton Road, or any proposed construction of
public housing, including, but not limited to the Low Rent
Housing for the Elderly Project, authorized for construction
on Lots 15 through 20, Block 111, Ocean Beach Addition No. 3,
Plat Book 2, page 81, of the Public Records of Dade County,
Florida, or to public buildings, or to hospitals and
hospital related buildings, as enumerated in Zoning Ordinance
No. 289, or to Single-Family Dwellings, or to permits for
repairs and alteration to existing structures.
The adoption of the above and foregoing resolution
was jointly moved by all of the Councilmen present and voting,
to wit : Mayor Jay Dermer, Vice-Mayor Leonard O. Weinstein,
Councilman Robert Goodman, Councilman Jerome Greene, Councilman
Herbert Magnes, and Councilman Harold Rosen. The said
resolution was thereafter unanimously adopted.
PASSED and ADOPTED this 3rd day of February , 1971.
