13335 • RESOLUTION NO. � 13335 � A RESOLUTION CALLING A SPECIAL ELECTION, TO BE • HELD ON NOVEMBER 2 , 1971, FOR THE PURPOSE OF SUBMITTING A PROPOSED CHARTER AMENDMENT TO THE ELECTORATE OF THE CITY OF MIAMI BEACH, FOR THEIR APPROVAL OR REJECTION, PROVIDING FOR THE PROHIBITION OF ANY DREDGING OR FILLING, OR THE ISSUANCE OF ANY PERMITS FOR DREDGING OR FILLING ANY AREA IN BISCAYNE BAY, OR ITS ADJOINING CANALS WITHIN THE CITY, AND PROVIDING FOR EXCEPTIONS THERETO. BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1: That a Special Election be and the same is hereby called and directed to be held on November 2 , 1971, for the purpose of submitting the following proposed Amendment to the Charter of the City of Miami Beach, for the approval or rejection by the electorate ; the proposed question being as follows : 1. "SHALL THE CITY CHARTER BE AMENDED, BY ADDING A NEW SECTION THERETO, TO BE NUMBERED SECTION 7-a, AND TO READ AS FOLLOWS : In order to preserve for all the citizens of Miami Beach the City' s natural scenic beauty and its open waters and to protect the ecology of Biscayne Bay, the City of Miami Beach shall not dredge, or fill or issue any permit to permit anyone else to dredge or fill any area of any kind in Biscayne Bay, or its adjoining canals within the City boundaries to or above the mean low water line, or establish a bulkhead line which would permit such dredging and filling, except where such fill will be less than one-half acre in area in the aggregate, and is required as an addition to an already existing land mass for the purpose of improving or repairing a shoreline or seawall, and such fill or dredging will not have an adverse effect on the ecology of the Bay, and is not for the purpose of creating a new island or land mass; anything in this Charter or the Ordinances of the City to the contrary notwithstanding. The prohibitions contained in this section shall not apply to any bulkhead and fill rights already ac- quired by ISLAND VIEW HOSPITAL CORPORATION on the date this amendment is adopted for the purpose of building a Hospital on lots fronting on Purdy Avenue, in Miami Beach, provided such bulkheading and filling are completed by December 31, 1978; nor to any Marina on municipally owned property between MacArthur Causeway and Government Cut, nor on municipally owned property at the westerly por- tion of Normandy Golf Course bordering Biscayne Bay, nor to the rerouting of Collins Canal, in ac- cordance with Gruen plan, or any modification thereof. SECTION 4 : That the City Clerk, who is also the Supervisor of Registration, shall open the books of said City from 9 o'clock A.M. to 5 o 'clock P.M. each day, Saturdays, Sundays, and Holidays excepted, from the 19th day of August, 1971 to and including October 2 , 1971, for the purpose of registering electors for the Special Election, to be held on November 2 , 1971, and that after said October 2, 1971, no voter shall be registered for said election. SECTION 5 : That the City Clerk and Finance Director be and she is hereby directed to publish once a week, for a period of four (4) consecutive weeks next preceding such Special Election, in the MIAMI BEACH SUN, a newspaper of general cir- culation, published in the City of Miami Beach, Florida, a Notice of said Special Election, as follows : "NOTICE OF SPECIAL ELECTION NOTICE IS HEREBY GIVEN that by Resolution duly passed and adopted by the City Council of the City of Miami Beach, a Special Election has been called, and will be held in the City of Miami Beach, Florida, from 7 :00 o 'clock A.M. to 7 :00 o'clock P.M. on the 2nd day of November, 1971, for the purpose of submitting the follow- ing question : 1. SHALL THE CITY CHARTER BE AMENDED, BY ADDING A NEW SECTION THERETO, TO BE NUMBERED SECTION 7-A, AND TO READ AS FOLLOWS : In order to preserve for all the citizens of Miami Beach the City's natural scenic beauty and its open waters and to protect the ecology of Biscayne Bay, the City of Miami Beach shall not dredge, or fill or issue any permit to permit anyone else to dredge or fill any area of any kind in Biscayne Bay, or its adjoining canals within the City boundaries to or above the mean low water line, or establish a bulkhead line which would permit such dredging and filling, except where such fill will be less than one-half acre in area in the aggregate, and is required as an addition to an already existing land mass for the purpose of improving or repairing a shoreline or seawall, and such fill or dredging will not have an adverse effect on the ecology of the Bay, and is not for the purpose of creating a new island or land mass ; any- thing in this Charter or the Ordinances of the City to the contrary notwithstanding. The prohibitions con- tained in this section shall not apply to any bulkhead and fill rights already acquired by ISLAND VIEW HOSPITAL CORPORATION on the date this amendment is adopted for the purpose of building a Hospital on lots fronting on Purdy Avenue, in Miami Beach, provided such bulkheading and filling are completed by December 31, 1978; nor to any Marina on municipally owned property between MacArthur Causeway and Government Cut, nor on municipally owned property at the westerly portion of Normandy Golf Course bordering Biscayne Bay, nor to the rerouting of Collins Canal, in accordance with the Gruen plan, or any modifi- cation thereof.
