13388 RESOLUTION NO. 13388
WHEREAS, the Director of Public Works of the
City of Miami Beach, Florida, has issued a Bulkhead and Fill
Permit to H. P. FORREST, Trustee for Island View Hospital,
dated May 26, 1971, subject to certain conditions, as set
forth therein, which permit provides for the bulkheading and
filling of described submerged land in Biscayne Bay lying
adjacent to Lots 1 through 9, Block 15, ISLAND VIEW SUBDIVISION;
and
WHEREAS, the Board of Trustees of the Internal
Improvement Fund has requested the City Council of the City
of Miami Beach, Florida., by Resolution, to approve, ratify
and confirm the issuance of said bulkhead and fill permit;
and
WHEREAS, the City Council of the City of Miami
Beach, Florida, has duly considered appropriate hydrographical,
biological and ecological reports and recommendations,
heretofore submitted to it and the summary of the biological
report having been read to it at the time of its approval of
said bulkhead line; and
WHEREAS, the City Council of the City of Miami
Beach, Florida, has duly found and determined that it is in
accordance with, and not violative of, any of the things,
conditions, or circumstances described and set forth in Section
253 . 124, Florida. Statutes;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH. FLORIDA, that the issuance
of said bulkhead and fill permit be and the same is hereby
approved, ratified and confirmed in accordance with the request
of the said Trustees of the Internal Improvement Fund, provided,
however, that there be added to the conditions presently
incorporated in and made a part of the said Bulkhead and Fill
Permit referred to in the first paragraph hereof, the following
additional proviso and condition, to be numbered and to read
as follows :
"8. That prior to commencement of bulkheading
and filling there shall be filed with the
Building Division, Department of Public Works,
City of Miami Beach, the following:
(a) A written, bona fide commitment for a
permanent mortgage loan from an institutional
lender such as a bank, life insurance company,
or other established lending institution, the
proceeds of which are to be used for construction
of a hospital on the land presently held by the
said H. P. Forrest, Trustee for Island View
Hospital, and the submerged land adjacent thereto
and which is the subject matter of said Bulkhead
and Fill Permit.
(b) A letter from a bank or other financial
institution to the effect that in addition to
the funds made available by reason of said
permanent mortgage, other or additional funds
are available so that the aggregate funds
available are sufficient to provide for
construction and completion of the hospital.

" (c) A certified copy of the recorded
mortgage on the premises to said lending
institution as evidence that the available
funds will be used for construction and
completion of the hospital";
it being the intent and purpose of the City Council of the
City of Miami Beach, Florida, that the dredging and filling
authorized by said Permit shall be performed only in
connection with, and as an integral part of the construction
of a hospital on the land acquired for said purpose by the
said H. P. Forrest, Trustee for Island View Hospital.
