RESOLUTION NO. 13426
A RESOLUTION CREATING A CITY OF MIAMI
BEACH BUDGET COMMISSION AND PRESCRIBING
ITS DUTIES, POWERS AND AUTHORITY.
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1. That a City of Miami Beach Budget Commission,
composed of seven (7) duly qualified and registered
voters of the City, qualified to carry out and execute the
responsibilities conferred upon them hereby, and having a
recognized reputation in the community for knowledge, skill and
ability in the fields of finance, banking, business, accountancy
and law, is hereby created. Two (2) members shall be from the
legal profession, two (2) from general business, and one (1)
member from each of the finance, banking and accountancy categories.
Each Councilman shall nominate and designate one member thereof.
The term of office of each member shall expire with that of the
City Councilman who has appointed the particular member to said
Commission.
SECTION 2 . That said Budget Commission shall elect one of its
members as Chairman, who shall serve for a term of
years. The City Clerk-Finance Director of the City of
Miami Beach shall serve as Secretary ex officio. All members of
the Budget Commission shall serve without pay, but they shall be
entitled to be reimbursed by the City for their actual expenses.
SECTION 3 . It shall be the duty of the City Clerk-Finance
Director, on or before June 1st of each year, to
furnish the Budget Commission with estimates of the valuations
of all real and personal property within the City, based upon
the assessment thereof for ad valorem tax purposes, as prepared
by the County Tax Assessor.
SECTION 4. It shall be the duty of the City Clerk-Finance
Director, on or before June 1st of each year, to
make an estimate of the cash balance which shall be on hand at
the beginning of the next fiscal year and of the revenues and
receipts (other than from current ad valorem taxes) which may
reasonably be expected during the next fiscal year. Such estimates
shall be delivered to the Commission for its use in the preparation
of an Advisory Budget and the same shall also be available to the
public at reasonable hours. It shall be the duty of the City
Clerk-Finance Director to furnish to the Budget Commission all
information in her possession or control that it may require in
the discharge of its duties, and to attend its meetings whenever
required by it.
SECTION 5. It shall be the duty of the City Clerk-Finance Director
to file with the Budget Commission, on or before
June 1st of each year, the following information, grouped by funds
and classified by the uniform system of accounts used in making
the annual reports of receipts and expenditures for the various
funds :
(1) An estimate of all ordinary and extraordinary receipts
(including cash balances to be carried over, current ad valorem
taxes and the proceeds of the sale or exchange of bonds or other
public obligations) which may reasonably be anticipated during
their ensuing respective fiscal years. Five percent shall be
deducted from the total anticipated receipts, and computations
shall be made so that the anticipated disbursements shall not
exceed the net total of ninety-five percent.

(2) An estimate of all ordinary and special and
extraordinary expenditures (including principal and interest
on outstanding bonds or obligations) which are contemplated
and are deemed necessary to be made during their ensuing
respective fiscal years .
(3) Opposite each item of the estimated revenues and
receipts and each of the proposed expenditures there shall be
the following information in separate parallel columns :
(a) The amounts of anticipated receipts and
disbursements in the budget for the present fiscal year (the
anticipated disbursements to be adjusted balances if any budget
transfers or increases have been authorized. )
(b) Actual receipts and disbursements for the past
fiscal year.
SECTION 6 : It shall be the duty of the Budget Commission to
advise the City Council, on or before July 1st
of each year, as to the amount of millage which it will recommend
the City Council to levy for the current tax year.
SECTION 7 : It shall be the duty of the Budget Commission to
examine, study and consider all the estimates
submitted to it as aforesaid. For that purpose, the Budget
Commission shall have the power itself or through any of its
members or its auditors or other employees , to investigate, pass
upon and determine the public necessity or propriety of any
proposed expenditures and the amount which should be appropriated
for that purpose, the probable amount of estimated revenues and
receipts and all other facts necessary or convenient to be known
in order to prepare a recommended budget for the ensuing fiscal
year.
SECTION 8 : When required by the Budget Commission, it shall be
duty of each officer and employee and every member or
employee of any Board to appear before the Commission at a time
and place to be fixed by it and to supply such further information
as may be had by or available to him and as may be determined by
the Commission to be necessary for the intelligent and proper
discharge of its duties .
SECTION 9 : The Secretary is required to publish one time in a
newspaper of general circulation a summary of the
fund totals of the budgets proposed by the Budget Commission and
a notice of the time and place for discussion thereof by the
public. The notice shall show in parallel columns opposite each
fund total a summary of the information herein provided for. The
notice shall precede the date for the said meeting by not less
than one week. It shall be the duty of all department heads to
be present at the public hearing for the purpose of answering
questions regarding their proposed departmental budgets . After
having given the public an opportunity for discussion in open
session at the time and place set, the Board is hereby authorized
and empowered to recommend to the City Council any change,
alteration, amendment, increase or decrease of and to any item,
and the total amount or amounts of any estimates of receipts or
expenditures set forth therein.
SECTION 10 : It shall be the duty of the Budget Commission, on
or before September 1st of each year, to certify
to the City Council and to the City Manager its proposed recommended
Budget of estimated receipts and expenditures of the City for
the ensuing fiscal year.

SECTION 11: The proposed budget so submitted to the City Council
shall be purely recommendatory and advisory and
shall not have the force of law, and its duties shall in nowise '
be deemed a delegation or transfer of the duties of any officer
or Councilman of the City.
