13439 RESOLUTION NO. 13439 WHEREAS, there has been submitted to the City Council of the City of Miami Beach, Florida, the Certificate of two members of said City Council and the City Clerk-Finance Director, of the result of the canvass of the returns of the Primary and Special Election held in said City on November 2, 1971 , and WHEREAS the said City Council has canvassed said returns and Certificate; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that it hereby adopts the said Certificate as to the results of said Election and it is hereby ordered that the same be recorded in the minutes of this meeting as a permanent record; AND IT IS FURTHER FOUND, DETERMINED AND RESOLVED that the names of the candi- dates for election to the office of Councilman in Group V, who placed first and second in said primary election are as follows: GROUP V Dr. Leonard Haber Dr. Simon J. Wikler and their names shall be placed on the ballot in the General Election to be held in said City on the 16th day of November, 1971 . QUESTION 1 : Shall the City of Miami Beach, Florida, issue negotiable coupon bonds in the amount of $10,500,000, with interest at a rate to be hereafter determined and not exceeding 8% per annum, for the purpose of installing, extending, constructing and reconstructing all necessary facilities for the collection of sewage and waste water in the City of Miami Beach, and tributary areas, and for the transmission thereof to a new sewage treatment plant on Virginia Key to be constructed as a joint project by the City of Miami Beach, the City of Miami and the City of Miami Department of Water and Sewers? 11 ,931 votes were cast FOR THE QUESTION, and 2,246 votes were cast AGAINST THE QUESTION. QUESTION 2: SHALL THE FOLLOWING AMENDMENT BE ADOPTED? 1 . SHALL THE CITY CHARTER BE AMENDED, BY ADDING A NEW SECTION THERETO, TO BE NUMBERED SECTION 7-A, AND TO READ AS FOLLOWS: In order to preserve for all the citizens of Miami Beach the City's natural scenic beauty and its open waters and to pro- tect the ecology of Biscayne Bay, the City of Miami Beach shall not dredge, or fill or issue any permit to permit anyone else to dredge or fill any area of any kind in Biscayne Bay, or its adjoining canals within the City boundaries to or above the mean low water line, or establish a bulkhead line which would permit such dredging and filling, except where such fill will be less than one-half acre in area in the aggregate, and is required as an addition to an already existing land mass for the purpose of improving or repairing a shoreline or sea- wall , and such fill or dredging will not have an adverse effect on the ecology of the Bay, and is not for the purpose of creating a new island or land mass; anything in this Charter or the Ordinances of the City to the contrary notwithstanding. The prohibitions contained in this section shall not apply to any bulkhead and fill rights already acquired by ISLAND VIEW HOSPITAL CORPORATION on the date this amendment is adopted for the purpose of building a Hospital on lots fronting on Purdy Avenue, in Miami Beach, provided such bulkheading and filling are completed by December 31 , 1978; nor to any Marina on municipally owned property between MacArthur Causeway and Government Cut, nor on municipally owned property at the westerly portion of Normandy Golf Course bordering Biscayne Bay, nor to the rerouting of Collins Canal , in accordance with the Gruen plan, or any modification thereof. 10,747 votes were cast FOR THE QUESTION, and 2,632 votes were cast AGAINST THE QUESTION. QUESTION 3: Shall Chapter 23414, Laws of Florida, Acts of 1945, being a part of the Charter of the City of Miami Beach, Florida, be amended so as to provide a service retirement allowance equal to three per cent (3%) of the average monthly salary or wages of the member multiplied by the number of his years of creditable service not in excess of twenty (20) plus two and three-quarters per cent (2-3/4%) of his average monthly salary or wages multiplied by the number of his years of creditable service in excess of twenty (20) , provided that the monthly pension shall not exceed eighty-five per cent (85%) of his average monthly salary or wages; and further provided that all employees who become members of the System after December 1 , 1971 shall contribute eight per cent (8%) of their salary or wages and that those who become members of the System on or before December 1 , 1971 shall have until December 31 , 1971 within which to elect to pay said increased contri- butions or shall be deemed to have elected irrevocably not to increase his contributions and not to receive the above described benefits. 10,001 votes were cast FOR THE QUESTION, and 3, 115 votes were cast AGAINST THE QUESTION. QUESTION 4: Shall Chapter 26024, Laws of Florida, Acts of 1949, being part of the Charter of the City of Miami Beach, Florida, be amended to provide as follows: (a) That the assistant city manager be a member of said board of trustees, rather than the city manager. (b) That the board of trustees have the power to invest the monies of the fund in dividend paying stocks, common or preferred, of any corporation created and existing under the laws of the United States or of any State, provided that the amount so invested shall at no time exceed thirty-five per cent (35%) of the total funds invested. (c) That the board of trustees shall have the power to invest monies of the fund in bonds, notes or other interest-bearing obligations of any solvent corporation organized under the laws of the United States or any State, territory or possession of the United States, 9, 176 votes were cast FOR THE QUESTION, and 3,475 votes were cast AGAINST THE QUESTION. QUESTION 5: SHALL THE FOLLOWING ORDINANCE BE ADOPTED: ORDINANCE NO. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1 : That there is a pressing need for the City of Miami Beach to provide facilities to protect the health, safety and welfare of its citizens, and that such need can be met in part by the providing of Emergency Service with a duly licensed physician to accompany all ambulance calls. SECTION 2: That all calls for emergency treatment of persons of Miami Beach shall be responded to by such emergency squad as may be provided, with a licensed physician to be a part of such emergency squad. SECTION 3: That there shall be included and provided on vehicles responding to emergency calls adequate lifesaving equipment to treat emergency heart patients and to evaluate the condition of such heart patients. SECTION 4: That adequate equipment shall be acquired by the City of Miami Beach, and adequate personnel shall be employed or contracted with to accomplish the life- saving service necessary for emergency treatment of persons on Miami Beach. SECTION 5: That all funds necessary to accomplish the purposes of this Ordinance shall be made available out of emergency funds and/or from the regular budget of the City of Miami Beach. SECTION 6: The provisions of this Ordinance shall become operative and effective ninety (90) days after this Ordinance shall be ratified and approved by a majority of the qualified electors voting in an initiative election to be held in the City of Miami Beach under applicable provisions of law and pursuant to Section 26 of the Charter of the City of Miami Beach, Florida, and pursuant to the Election Laws of the City of Miami Beach, Florida. 9,803 votes were cast FOR THE QUESTION, and 3,671 votes were cast AGAINST THE QUESTION. • QUESTION 6: SHALL THE ORDINANCE ENTITLED "AN ORDINANCE PROVIDING FOR THE CREATION AND MAINTENANCE OF A RETIREMENT SYSTEM FOR THE GENERAL EMPLOYEES OF THE CITY OF MIAMI BEACH, FLORIDA" BE ADOPTED? 8,733 votes were cast FOR THE QUESTION, and 3,441 votes were cast AGAINST THE QUESTION.
