'1 day of MRJt.- , 1999, by and between the STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION, an agency of the State of Florida, hereinafter called the DEPARTMENT, and the City of Miami Beach of 1700 Convention Center Drive. Miami Beach. Florida 33139 a political subdivision of the State of Florida, hereinafter called the CITY. WIT N ESE T H : WHEREAS, the DEPARTMENT and the CITY heretofore on the 10th day of June 1997, entered into an AGREEMENT whereby the DEPARTMENT retained the CITY to provide turf and landscape maintenance services on 1-195. (Julia Tuttle Causeway) and WHEREAS, the DEPARTMENT has determined it necessary to amend the AGREEMENT to reimburse the CITY for the cost of replacing landscape plants that were damaged as a result of automobile accidents. natural disasters and lethal yellowing as agreed to by both parties and noted in Attachment A and B. NOW, THEREFORE, this AGREEMENT witnesseth the following amendments are made; The DEPARTMENT agrees to reimburse the CITY with a one time lump sum payment of $57,260.00 in the DEPARTMENT I s fiscal year 1999/2000 as compensation to the CITY for replacing the landscape plants listed below: 55 Coconut Palms with an 8-10ft wood @ $800 ea 200 Silver Buttonwood Hedges in 3 gal containers @ $9 ea 240 Oleanders in 3 gal containers @ $9 ea 400 Fachahachee Grass in 3 gal containers @ $12 ea 20 Sable Palms with a 15ft wood @ $225 ea $44,000.00 $ 1,800.00 $ 2,160.00 $ 4,800.00 S 4.500.00 = $57,260.00 Total EXCEPT as hereby modified, amended, or changed, all of the terms and conditions of said Agreement and any supplements and amendments thereto shall remain in full force and effect. 1 Contract No.: B-A986 Amendmen t No. 2 IN WITNESS WHEREOF, the parties hereto have caused these presents to be executed, the day and year first above written. For the replacement oflandscaping on the MacArthur Causeway due to the loss ofveget4tion as a result of accidents, storms and lethal yellowing. As indicated in your recent letter. an amendment to the maintenance agreement for the MacArthur Causeway is being prepared by the Florida Department of Transportation (FOOl) to provide $88.800 to the City in the current fISCal year. In reference to the Julia Tuttle Causeway, the FOOT will prepare an amendment to the maintenance agreement to provide the Gty $57,260 in the next fiscal year. Upon your transmittal of the contract amendments. the Gty will expeditiousfy process them.
