A RESOLUTION CALLING A SPECIAL ELECTION
TO BE HELD ON MARCH 14, 1972, FOR THE
PURPOSE OF SUBMITTING A PROPOSED CHARTER
AMENDMENT TO THE ELECTORATE OF THE CITY
OF MIAMI BEACH. FOR THEIR APPROVAL OR
REJECTION PROVIDING FOR THE ELIMINATION
OF PRESENT EXISTING REQUIREMENTS FOR THE
READING OF ORDINANCES PRIOR TO ADOPTION
AND PROVIDING A NEW PROCEDURE FOR THE
ADOPTION OF ORDINANCES .
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA :
SECTION 1. That a Special Election be and the same is hereby
called and directed to be held on March 14, 1972,
for the purpose of submitting the following proposed amendment
to the Charter of the City of Miami Beach, for the approval
or rejection by the electorate; the proposed question being as
follows :
"Shall the City Charter be amended so as to delete
from Section 9 thereof the existing procedure for
the adoption of ordinances and substituting therefor
the following provisions :
'Every ordinance shall be introduced in
writing and shall contain a brief title .
The enacting clause shall be 'BE IT
ORDAINED BY THE CITY COUNCIL. ' After
passage on first reading, which may be by
title only, a short summary of the ordinance
shall be published in a newspaper of general
circulation at least once, together with a
notice of the time when and place where it
shall be given a public hearing and be
considered for final passage. The notice
shall also recite that the proposed ordinance
is on file in the office of the City Clerk
for examination by the public. The first
such publication shall be at least one week
prior to the time advertised for hearing.
In addition, after passage upon first reading,
a true copy of the proposed ordinance shall be
posted in a prominent place in the Council
Chambers and also in the City Hall, together
with a notice of the time and place of the
public hearing to be held thereon prior to
its proposed adoption on second reading.
No ordinance shall be declared invalid by
reason of anydefect in publication or title
if the published summary gives reasonable
notice of its intent. At the time and place
so advertised, or at any time and place to
which such public hearing may, from time to
time, be adjourned, the ordinance shall be
read by title and a public hearing shall be
held. After the hearing, the City Council
may pass the ordinance with or without amendment.
The effective date of any ordinance shall be
prescribed therein, but the effective date shall
not be earlier than ten (10) days after its

' enactment. To meet a public emergency
affecting life, health, property or public
safety, the City Council, by two-thirds
vote of the members of the City Council,
may adopt an emergency ordinance at the
meeting at which it is introduced and may
make it effective immediately. After the
adoption of an emergency ordinance, the
City Council shall cause it to be published
in full within ten (10) days in a newspaper
of general circulation.'"
SECTION 2 . That for the purpose of holding and conducting
the Special Election to be held on March 14, 1972,
the City of Miami Beach has been divided into voting precincts
and election districts, with polling places therein, as follows :

PRECINCT NO. 58: That part of the City of Miami Beach bounded on the North and
West by the limits of the City of Miami Beach; bounded on the
South by the center line of Indian Creek; bounded on the East by a line described
as follows: beginning at the intersection of the center line of Indian Creek and
the center line of Tatum Waterway run Northerly along Tatum Waterway to the Southerly
extension of the center line of Hawthorne Ave. , thence run Northerly along the
center line of Hawthorne Ave. to the center line of 31 Street, Miami Beach; thence
run Easterly along the center line of 81 Street to the center line of Tatum Waterway;
thence run Northerly to the boundary of the City of Miami Beach; the Polling Place -
of which shall be at the Biscayne Elementary School , situated at 800 - 77th Street.
PRECINCT NO. 59: Bounded on the North by the center line of 77th Street; bounded

PRECINCT NO. 60: All that part of Miami Beach known as Normandy isle and its
surrounding waters which lie Southerly of the line Described as
follows: beginning at the East end of the 79th Street Causeway bridge run Easterly
along the center line of Normandy Drive to the center line of Verdun; thence run
Northwesterly along Verdun to the center line of Marseille Drive; thence run
Easterly along Marseille Drive to the center line of Rue Notre Dame; thence run
Southeasterly to the center line of Normandy Drive; thence run Easterly to Indian
Creek; the Polling Place of which shall be at the Normandy Isle Municipal Pool ,
situated at 7030 Trouville Esplanade.
PRECINCT NO. 80: Bounded on the North by the center line of LaGorce Canal from
Biscayne Bay to the West line of Indian Creek and the center line
of 63rd Street from the East Shore of Allison Island to the Atlantic Ocean; bounded
on the South by the center line of 51st Street and its Westerly and Easterly exten-
sions; bounded on the East by the East boundary of the State of Florida; bounded on
the !lest by the City Limits of Miami ; the Polling Place of which shall be at the
69th Street Fire Station, situated at 6860 Indian Creek Drive.
PRECINCT NO. 81 : Bounded on the North by the center line of 44th Street and its
Easterly and Westerly extensions; bounded on the South by the
center line of 34th Street and its Easterly and Westerly extensions; bounded on the
East by the East boundary of the State of Florida; bounded on the West by the center
line of Biscayne Waterway; the Polling Place of which shall be at the North Beach
Elementary School , situated at 711 Arthur Godfrey Road.

SECTION 3. That copies of the proposed amendment to the City
Charter, in full, shall be made available to the
electors at the office of the City Clerk from 9 :00 o' clock
A.M. to 5 :00 o' clock P.M. each day, Saturdays, Sundays and
Holidays excepted, from February 12, 1972, up to and including
March 14, 1972 .
SECTION 4. That the Dade County Registration Officer shall
open the registration books of said County from
9:00 o' clock A.M. to 5 :00 o' clock P.M. each day, Saturdays,
Sundays and Holidays excepted, from the 6th day of January,
1972, up to and including February 12, 1972, for the purpose
of registering electors for the Special Election to be held on
March 14, 1972, and that after said February 12, 1972, no voter
shall be registered for said election.
SECTION 5. That the City Clerk-Finance Director be, and she
is hereby directed to publish once a week, for a
period of four (4) consecutive weeks next preceding such Special
Election, in the Miami Beach Sun-Reporter, a newspaper of
general circulation, published in the City of Miami Beach, Florida,
a Notice of said Special Election, as follows :
"CITY OF MIAMI BEACH, FLORIDA,
NOTICE OF SPECIAL ELECTION
NOTICE IS HEREBY GIVEN that an election has been
called by the City Council of the City of Miami
Beach, Florida, and will be held in said City
from 7 :00 o' clock A.M. to 7 :00 o'clock P.M. on

"All electors shall vote at the polling places
in the voting precincts in which the Dade County
Registration Books show that said electors reside.
The Registration Books of said County shall be
open from 9 :00 o' clock A.M. until 5 :00 o' clock
P.M. each day, Saturdays, Sundays and Holidays
excepted, from the 6th day of January, 1972, up
to and including February 12, 1972, for the
purpose of registering any person qualified to
vote in said election. "
SECTION 6. That the official ballot to be used in the Special
Election to be held on March 14, 1972, hereby
called, shall be in substantially the following form, to wit:
"SHALL THE FOLLOWING PROPOSAL BE APPROVED OR
REJECTED?
"Shall the City Charter be amended so as to provide
a new procedure for the adoption of ordinances by
the City Council; requiring public hearing, pursuant
to published notice, prior to the passage of any

require two readings of any ordinance, by title
only; and to require the publication of a short
summary of all ordinances prior to such public
hearing, except for emergency ordinances which
shall be published in full within ten (10) days .
