RESOLUTION NO. 1351+6
A RESOLUTION MODIFYING AND REDUCING
CERTAIN ASSESSMENT CONFIRMED IN
RESOLUTION NO. 11842 AND AUTHORIZING
REFUND OF BALANCE DUE UNDER RESOLUTION
NO. 10960.
WHEREAS, the City Council of the City of Miami
Beach, Florida, did, on May 18, 1966, pass and adopt Resolution
No. 11840, wherein certain prima facie assessments for the
cost of Sidewalk Improvement SK-275, District SK-275, as
filed with the City Council on May 18, 1966, were confirmed, and
WHEREAS, it has subsequently been determined that
a modification and reduction in said assessments is required as
to certain lots or parcels as hereinafter described, for the
reasons delineated by the Director of Public Works, as follows :

All of said parcels being Parkview Point subdivision, resub of
Lots 27-40, Block 1, and Lots 1-10, Block 2, Parkview Island,
Plat Book 77, page 12, Public Record of Dade County, Florida,
and
WHEREAS, under the terms and provisions of Resolution
No. 10960, the said Joseph and Sarah Gordon, the owners of the
parcels of land hereinabove described, also paid to the City
on June 2, 1964, the sum of $21, 168 . 35 for the construction of
certain roadwork and the relocation of sanitary storm sewers
sewers and water mains, from which sum there is now due and
owing to the said Joseph and Sarah Gordon the sum of $1800. 20,
which sum has been authorized by the said Joseph and Sarah
Gordon to be applied toward the payment of the corrected balance

due and owing to the City for the sidewalk improvement liens
hereinabove described, and
WHEREAS, the reason and the purpose of the surety
bond described in said Resolution No. 10960 has been fully
performed and there is no need or occasion for the same to
remain in force and effect;
NOW, THEREFORE, BE IT DULY RESOLVED BY TUE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the
assessments hereinabove described be, and the same are hereby
adjusted, corrected and modified as hereinabove set forth
and that the same may be fully paid, satisfied and discharged
by the payment of the said corrected and adjusted amount of
$5, 512. 33, and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the said sum of $1800.20
held in escrow by the City of Miami Beach be, and the same
is hereby, with the consent and direction of the said Joseph
and Sarah Gordon, applied as a credit on the said indebtedness
of $5512. 33 of the said Joseph and Sarah Gordon to the City,
and that upon payment of the balance, to wit: $3712. 13, the
said assessment liens as changed, adjusted and modified,
hereby shall be fully paid, discharged and satisfied of record,
and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that the surety bond posted by
the said Joseph and Sarah Gordon, as required by Resolution
No. 10960, be, and the same is hereby discharged and that the
said principals, Joseph and Sarah Gordon, and the corporate
surety thereon, Continental Casualty Company, be, and they
are hereby relieved and discharged of all liability thereon.
