A RESOLUTION CREATING THE CITY OF
MIAMI BEACH HEALTH PLANNING COMMISSION
AND PRESCRIBING ITS MEMBERSHIP, DUTIES,
POWER AND AUTHORITY
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That a City of Miami Beach Health Planning Commission
is hereby created. Its membership shall be composed
of nine members appointed by the City Council, and whose term
of office shall be two years from date of appointment or until
a successor is appointed or qualified, except unexpired terms,
in which case the appointment shall be to the end of the unexpired
term only. Said Commission shall elect one of its members as
Chairman who shall serve for a term of two years. All members
of the Commission shall serve without pay, but they shall be
entitled to be reimbursed for their actual expenses.
SECTION 2: The members of the Health Planning Commission shall
be comprised of three members who are duly licensed
by the State of Florida to practice medicine, or other health
science; three members who possess appropriate professional
experience in the operation of hospitals and shall be eminently
representative of the hospitals operated and maintained in the
City; and three members of the public at large, each of whom
possess a demonstrated experience and devotion to the interests
of the health needs of the citizens of Miami Beach, and of the
community.
SECTION 3: It shall be the duty and responsibility of the Health
Planning Commission to examine, consider and study
all the health needs of the citizens of the City of Miami Beach
and to formulate for the advice and guidance of the City Council
general policies affecting the physical and mental health of its
citizens and residents; to advise the City Council of its
recommendations for the implementation of such plans and policies;
to consult with the representatives of the several hospitals of
the community as to methods and means of rendering the utilization
of their facilities to the greater benefit of those persons in
the community in need of hospital services and facilities ; to
formulate, in cooperation with the medical and health science
professions , programs for the benefit of the general public, and
for the advice of the City Council in areas relating to the
proper care and treatment of persons needing medical, health or
hospitalization needs and facilities ; to formulate, undertake,
and carry out programs with the approval of the City Council in
participation, cooperation and assistance with other properly
qualified agencies , including any County, State o ' Federal
agencies, for the purpose of making medical, health and hospital
facilities more readily available to the public of the City of
Miami Beach and such other powers, duties and responsibilities
as the City Council may confer upon said Health Planning Commission
from time to time.

SECTION 4: The functions of the Health Planning Commission
shall be purely recommendatory and advisory to the
City Council, and shall not have the force of law, or to be
deemed in any way a delegation of the power and authority of
the City Council.
