13558 s RESOLUTION NO. 13558 WHEREAS, the City Council of the City of Miami Beach, Florida, has called, and there will be held in the City of Miami Beach, Florida, a special election for the approval or rejection by the electorate of the City of Miami Beach of certain bond issues, among which are Question No. 1 providing for authorization to issue bonds up to the amount of $2, 000, 000. 00 for the acquisition of Lots 1 through 6, less the Westerly 15 feet of Block 1, FRIEDMAN COPE SUB- DIVISION, Plat Book 4, page 83, of the Public Records of Dade County, Florida, said property being commonly known as the Shoreham-Norman Hotel property at the Northeast corner of 5th Street and Ocean Drive, and adjoining Lummus Park, and Question No. 2 providing for the authorization by the electorate for the issuance of bonds by the City of Miami Beach in the sum of $1, 500, 000. 00 for the acquisition for public park purposes, said land described as Lots 7, 8 and 9 of Block 1, Amended Plat of SECOND OCEANFRONT SUBDIVISION, Plat Book 28, page 28, of the Public Records of Dade County, Florida, commonly known as the Bell Property in the 5700 Block of Collins Avenue, and WHEREAS, it has come to the attention of the City Council of the City of Miami Beach, Florida, that some members of the electorate of the City of Miami Beach are under the belief that by the submission of such questions for the approval or rejection by the electorate that it is the intent of the City Council to expend the entirety of said specified sums for the acquisition of said parcels of land, and WHEREAS, such belief, as such there be, is not well founded and is contrary to the fact; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the electorate of the City of Miami Beach, Florida, be advised and informed through all available publicity and dissemination of information through the several news media, that the said respective sums of money expressed in said bond questions do not represent the price or consideration which the City intends to pay for the acquisition of said properties, but that the said respective sums specified in said bond questions represent the best available estimate of the total cost to the City, not only of the purchase price, but also any necessary court costs and attorneys fees that are payable under the law in the event that it is necessary for the City to institute condemnation proceedings for the acquisition of said properties, and also the cost of preparing, improving, landscaping, and otherwise making the said properties suitable and proper for public purpose use, and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the electorate of the City of Miami Beach be advised and informed through all available publicity and dissemination of information through the several news media that in no event will the City pay more than the fair market value thereof as determined by duly qualified and competent licensed appraisers having suitable professional -1- OFFICE OF CITY ATTORNEY-1130 WASHINGTON AVENUE-MIAMI BEACH, FLORIDA 33139 i standing, such as membership in the American Institute of Real Estate Appraisers, commonly known as M.A. I . , and in no event more than the value thereof found and determined by a duly qualified jury of twelve (12) , and court costs under appropriate condemnation proceedings instituted by the City.
