ENTITLED "PRODUCTION INDUSTRY
COUNCIL", BY AMENDING THE COMPOSITION
OF THE COUNCIL BY DELETING THE
REPRESENTATIVES FROM THE MIAMI-DADE
OFFICE OF FILM, TELEVISION AND PRINT
AND THE CITY'S FILM, TELEVISION AND
PRINT OFFICE AS NONVOTING, EX-OFFICIO
MEMBERS; PROVIDING FOR REPEALER;
PROVIDING FOR SEVERABILITY; PROVIDING
FOR CODIFICATION; AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, in order to facilitate the function of the Production Industxy Council, the ex-officio
members of said Council from the Miami-Dade Office of Film, Televison and Print and the City's Film,
Television and Print Office should be removed from the Council and participate as needed as members
of the public.
NOW, THEREFORE, BE IT DULY ORDAINlED BY THE MAYOR AND CITY
COMMISSION OF THE CITY OF MIAMI BEACH, FLORIDA AS FOLLOWS:
SECTION 1.
That Division 7 entitled "Production Industry COuncil" of Article !It, Chapter 2 of the Miami
Beach City Code is hereby amended as follows:
Sec. 2-71.
DIVISION 7. PRODUCTION INDUSTRY COUNCIL
Established; purpose; powers and duties; composition
(d) Composition. The council shall be composed of seven voting members; the mayor and
each commissioner shall make one direct appointment. Rcprcscntativcs from thc Mctro Mianli Dadc
Office ofFihn, Tclcvision and Print, and thc city ~h~, television and print office shall be included as
nonvoting, cx-officio n~mbcrs.
SECTION 2. CODIFICATION
It is the intention of the Mayor and City Commission of the City of Miami Beach, and it is
hereby ordalned that the provisions of this ordinance shall become and be made a part of the Code of
the City of Miami Beach, Florida. The sections of this ordinance may be renumbered or relettered to
accomplish such intention, and the word "ordinance" may be changed to "section", "article," or other
appropriate word.
SECTION 3. REPEAI,ER
All ordinances or parts of ordinances in conflict herewith be and the same are hereby repealed.
SECTION 4. SEVERABII,ITY
If any section, sentence, clause or phrase of this ordinance is held to be invalid or
unconstitutional by any court of competent jurisdiction, then said holding shall in no way affect the

validity of the remaining portions of this ordinance.
SECTION 5. EFFECTIVE DATE
This Ordinance shall take effect on the 8th day of
December ,2001.

ADMINISTRATION RECOMMENDATION:
Adopt the Ordinance on the second and final reading.
ANALYSIS:
At the Production Industry Council (PIC) meeting of March 13, 2001, Deputy City Attomey,
Jean Olin made a presentation on the Sunshine Law to the new and existing board
members. A question was posed to Ms. Olin regarding ex-officio members and what
conversations they can conduct with board members. Ms. Olin said those conversations
would be considered a violation of Florida's Sunshine Law. Subsequent to that meeting,
both ex-officio members from the Miami-Dade Office of Film, Television and Print and the
City's Film, Television and Print Office resigned from the PIC in order to maintain effective
communication with industry representatives that sit on the PIC. The Miami-Dade Film,
Television and Print Office and the City's Office of Film, Television and Print will continue
to attend PIC meetings as members of the public.
On October 17, 2001, the proposed amendment was adopted on first reading and the
second reading/public hearing was set for November 28, 2001.
As such, the Administration recommends that the City Commission review and adopt the
proposed amendment deleting the ex-officio members from the Production Industry
Council.
