13705 • RESOLUTION NO. 13705 A RESOLUTION ON AUTHORIZING AND DIRECTING THE PLANNING BOARD TO CALL PUBLIC HEARING ON PROPOSED AMENDMENT TO ZONING ORDINANCE AUTHORIZING SIDEWALK CAFES. WHEREAS, the City Council of the City of Miami Beach, Florida, is considering amending Ordinance No. 1891, being the comprehensive Zoning Ordinance of the City of Miami Beach so as to authorize and permit sidewalk cafes, on the Lincoln Road Mall and on the proposed Malecon between appro- priate areas of Indian Creek and Collins Avenue, as an adjunct or appurtenance to bona fide restaurants located on private property immedately abutting such thoroughfares, subject to such rules, regulations, provisos and conditions as shall be promulgated by the City Council and subject to prior find- ings and determinations by the City Council that such permitted sidewalk cafes will not constitute or create unreasonable ob- structions to the prior and paramount right of the public for passage upon such public ways, now therefore BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that pursuant to the provisions of Section 16 of said Ordinance No. 1891, the Planning Board of the City of Miami Beach is hereby directed and authorized to hold an appropriate public hearing or hearings on such proposed amendment and to submit its report and recommendations thereon to the City Council in accordance with the provisions of said Section 16.
