13708 RESOLUTION NO. 13 708 WHEREAS, the Miami Beach Federal Credit Union has applied to the City of Miami Beach for a permit for certain reconstruction and rehabilitative work upon an existing store building located at 1753 Alton Road, Miami Beach, the legal description of which is as follows : Lots 10 and 11, Block 18 of FIRST ADDITION TO COMMERCIAL SUBDIVISION, according to the plat thereof as recorded in Plat Book 6 at Page 30 of the Public Records of Dade County, Florida; and WHEREAS, it has been determined that the said existing building possesses an existing five-foot cantilever projection originally built in 1941-42 which projects over and above the sidewalk abutting said building; and WHEREAS , plans for their remodeling, reconstruction, and rehabilitative work were approved by the Building Depart- ment on May 10, 1972, and all permits required for the work done to date were properly applied for and received; and WHEREAS, the approval of the City Council is required for the continuance of said projection over the said sidewalk; and WHEREAS, the Building Department has recommended that said projection be permitted to continue, as rehabilitated and remodeled so as to conform architecturally with the re- maining portion of the improvements being made to the exterior surface of the said building; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that insofar as it lies within the power and authority of the City Council of the City of Miami Beach to authorize and permit the con- tinuance of the existing projection, including an additional one-inch of stucco contemplated by such rehabilitative work, such authorization and permission is hereby granted; this authorization being conditioned upon the following: 1. That the prior and paramount right of the public for the use of the sidewalk shall not in any way be reduced or impaired; 2 . That this authorization shall continue only for the life of the existing structure and building, and as reconstructed, repaired, and rehabilitated. PASSED and ADOPTED this 16th day of August , 1972 .
