13728 • RESOLUTION NO. 13728 ' 4,,]�J WHEREAS, on August 29 , 1970, one DENNIS MAYO, a City of Miami Beach lifeguard, was making a rescue and was thrown against the jetty, injuring his left arm, shoulder, and chest, and WHEREAS, said employee was examined and treated by Drs . Grossman and Hall, and required surgery by Dr. Patrick Barry, and WHEREAS , the City Attorney recommends that it is in the best interest of the City to enter into a settle- ment under the provisions of FSS 440 . 20 (10) , as amended, 1967, such settlement to be in the total amount of $2 ,548. 00 of which $1,960 . 00 is for permanent partial disability to his body as a whole and all past, present or future compen- sation and medical benefits due Mr. Mayo, and the remaining $588. 00 represents a reasonable attorney ' s fee, and WHEREAS , the Order of the Judge of Industrial Claims approving such settlement stipulation will not be subject to modification or review, and WHEREAS, the City Council deems it to be in the best interest of the City to accept the recommendation of the City Attorney to enter into a final settlement stipula- tion as herein before set forth, NOW, THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney be authorized to enter into final settlement stipulation with Dennis Mayo and his attorney, and if said settlement is approved by a Judge of Industrial Claims, the Mayor, City Clerk-Finance Director and the City Attorney be, and they are hereby authorized and directed to comply with the Order of the Judge approving said stipulation.
