RESOLUTION NO. 13730
WHEREAS, the City Council of the City of Miami
Beach, Florida, deems it to be necessary for the welfare
of said City and the inhabitants thereof to acquire for
public off-street parking of vehicles the following de-
scribed parcel of land situate, lying and being in Miami
Beach, Dade County, Florida, to wit :
Lots 1 and 2, Block 6, 41st STREET
BUSINESS SUBDIVISION, according to
the Plat thereof recorded in Plat
Book 34 at page 92 of the Public
Records of Dade County, Florida,
NOW,THEREFORE, BE IT DULY RESOLVED BY THE CITY
COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that it is
necessary that the fee simple title to the above described
property be acquired for use for public off-street vehicu-
lar parking purpose, as hereinabove described for the bene-
fit of said City and its inhabitants, and
BE IT FURTHER RESOLVED, by the City Council of
the City of Miami Beach, Florida that S. Z. Bennett,
American Institute of Appraisers, the City' s real estate
consultant, be and he is hereby authorized, empowered, and
directed to negotiate with the owners of the hereinabove
described parcels of land, and to determine if an agreement
regarding the consideration and other provisions for the sale
and purchase thereof can be reached and to present such pro-
posed agreement with the owners to the City Council , and
BE IT FURTHER RESOLVED, by the City Council of
the City of Miami Beach, Florida that in the event that
the City Council is advised that such agreement cannot be
reached, the City Attorney be and he is hereby authorized
and directed to institute the necessary legal proceedings
in the name of said City in the exercise of its right of
eminent domain for the condemnation of said parcels for the
purpose hereinabove set forth.
