RESOLUTION NO. 13 754
WHEREAS, the City Council of Miami Beach, Dade County,
Florida, pursuant to law, called a Public Hearing which was held
on September 20, 1972, at a duly convened regular meeting of the
City Council of the City of Miami Beach, to consider the vacating
and abandoning of that portion of a dedicated public street or
right of way lying south of the northerly line of Lot 1, Block 2,
extending easterly to a point of intersection of that certain
property owned by the School Board of Dade County, all as shown
by the plat of Tatum Waterway Subdivision according to the plat
thereof recorded in Plat Book 46 at page 2 of the public records
of Dade County, Florida; and
WHEREAS, following said Public Hearing, City Council
has duly found and determined that there is no public need or
demand for a public street or way as located and that the
maintenance and responsibility therefor far exceeds the benefits
to the public by the continuance thereof; and
WHEREAS , City Council of the City of Miami Beach has
duly found and determined that it is in the best interests of
the City and its residents that said public street and right
of way be abandoned and vacated;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that that portion of that
certain street or right of way shown as "Tatum Waterway Drive"
lying south of the northerly line of Lot 1, Block 2 , projected
easterly to its point of intersection with the Dade County
School Board property as shown by the plat of Tatum Waterway
Subdivision according to the plat thereof recorded in Plat
Book 46 at page 2, be and the same is hereby abandoned and
vacated; provided however that the City retains the right to
mainteii1.1 operate, repair and replace by its or by any licensee
or a holder of a franchise from the City, any poles, wires,
pipes, conduits, sewer mains, water mains, or any other facility
or equipment for the maintenance or operation of any utility
now located in the street or portion thereof vacated by this
resolution.
