13784 RESOLUTION NO. 13784 A RESOLUTION PLEDGING FULL SUPPORT AND COOPERATION OF THE CITY OF MIAMI BEACH, FLORIDA, WITH THE OBJECTIVES AND PRO- GRAMS OF THE FLORIDA POLLUTION CONTROL BOARD AND ALL EXISTING AND FUTURE LE- GISLATION OF THE STATE OF FLORIDA RELA- TING TO THE ELIMINATION OF POLLUTION AND THE PRESERVATION OF THE ECOLOGY OF THE STATE OF FLORIDA WHEREAS , the State of Florida, by and through its Department of Pollution Control has duly directed the City of Miami Beach, Florida, to take corrective action in con- nection with its operation of its sewage treatment and disposal facilities, by prohibiting any increase in the quantity of sewage being discharged through the aforesaid system, and WHEREAS , the City Council of the City of Miami Beach, Florida, deems it meet and appropriate to enunciate officially and publicly its views and position in relation to the afore- said directive, NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that: 1. It is the desire and intent of the City Council of the City of Miami Beach, Florida, not only to comply, fully and completely, with all directives of the said State Pollution Control Board, but also to pledge its total and unstinting support, cooperation, and every possible aid and assistance to the said Pollution Control Board in its most laudable and praiseworthy objectives and goals for the projected eventual elimination and eradication of all forms of pollution; 2 . The City Council of the City of Miami Beach, Florida, proposes not only to follow and to comply with the full spirit and intent of all existing and future legislation related to the elimination of such pollution, and pertaining to the pre- servation of the ecology of the State of Florida; 3 . The City Council of the City of Miami Beach, Florida, intends and proposes that the City of Miami Beach, Florida shall assume, and continue to occupy its rightful position of leader- ship and pre-eminence in the aforesaid areas; and BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that in accordance, and with full conso- nance with the aforesaid directive of the Pollution Control Board dated the 3rd day of October, 1972 , and effective immedia- tely and forthwith: 1. That the proper administrative officers and depart- ments of the City of Miami Beach, Florida, shall not permit any increase in the quantity of sewage disposed through the afore- said system; and to this end, they shall immediately prohibit -1- OFFICE OF CITY ATTORNEY-1130 WASHINGTON AVENUE-MIAMI BEACH, FLORIDA 33139 and otherwise refuse to authorize in any fashion any sewerage connections to any collection system which flows into afore- said sewerage system and sewage treatment and disposal system, except where : (a) A valid permit to connect was issued prior to the date of receipt of the aforesaid directive of the Pollution Control Board; or ;(b) Prior to receipt of said directive for Corrective Action, a properly completed application for a permit to con- nect was received by the City of Miami Beach and the proposed connection will comply with all applicable laws and regulations. 2. In no event shall the City of Miami Beach after December 31, 1972, allow any connection to or additional flow into its sewerage system and sewage treatment and disposal system notwithstanding the existence of any permit or appli- cation; provided, however, that this provision shall not be applicable to Federal, State or Municipal structures, or to any buildings presently under construction, or for which per- mits have been issued. 3. Section 1 of this Paragraph shall be in effect until the City of Miami Beach, Florida provides at least 90% removal of contaminants prior to discharge and until the afore- said systems are otherwise in complete compliance with law. 4. That the City of Miami Beach, Florida shall take immediately and forthwith all possible and available action, in conjunction, and in cooperation with the City of Miami Water and Sewer Board to expedite and accelerate, with all possible speed, the completion of the modern sewage disposal facilities contemplated to be constructed under the existing contract therefor between the City of Miami Beach and the City of Miami Water and Sewer Board.
