13786 RESOLUTION NO. 13786
WHEREAS, on August 29, 1970, one DENNIS MAYO, a
City of Miami Beach lifeguard, was making a rescue and
was thrown against the jetty, injuring. riis left arm,
shoulder, and chest, and
WHEREAS, said employee was examined and treated
by Drs. Grossman and Hall, and required surgery by
Dr. Patrick Barry, and
WHEREAS, based upon the City Attorney's recommen-
dation that it would be in the best interest of the City
to enter into a settlement under the provisions of FSS
440. 20 ( 10) , as amended, 1967, in the total amount of
$2, 548.00 of which $1, 960.00 was to be for permanent
partial disability to his body as a whole and all past,
present or future compensation and medical benefits
due Mr. Mayo, and the remaining $588.00 was to represent
a reasonable attorney ' s fee, and
WHEREAS, based upon said recommendation City Council
duly adopted Resolution 13728, on September 6, 1972
approving such proposed settlement, and
WHEREAS, thereafter Judge Hayes Wood, Industrial
Claims Judge, refused to approve such proposed settle-
ment and required that said proposed settlement be in-
creased to a total amount of $2, 548.00 to Claimant, for
permanent partial disability to his body as a whole and
all past, present or future benefits due Mr. Mayo and
an increase in Claimant' s attorney' s fee from $588.00 to
$764.41, for a total of $3, 312.41, and
WHEREAS, the"City''Fthturney has recommended that the
increased amount of settlement be approved by the City
Council, and
WHEREAS , the City Council deems it to be in the best
interest of the City to accept the recommendation of the
City Attorney to enter into a final settlement stipulation
as herein before set forth,
NOW, THEREFORE, BE IT RESOLVED BY THIS CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney
be authorized to enter into final settlement stipulation
with Dennis Mayo and his attorney, and if said settlement is
approved by a Judge of Industrial Claims, the Mayor, City
Clerk-Finance Director and the City Attorney be, and they
are hereby authorized and directed to comply with the Order
of the Judge approving said stipulation; and
BE IT FURTHER RESOLVED that Resolution No. 13728
passed and adopted on September 6, 1972 be and the same is
hereby rescinded.
PASSED and ADOPTED this 18th day of October, 1972.
