13798 / RESOLUTION NO. 13798 WHEREAS, the Greater Miami Hebrew Academy, a non-profit corporation duly organized and existing under the laws of the State of Florida, has duly made request of the City Council of the City of Miami Beach for leave to construct, erect, and maintain a menorah, the dimensions and foundation design of which have been made known to the City Council,upon a certain portion of open space between two driveways leading to an existing educational facility known as the Greater Miami Hebrew Academy, said open space being a part of a parcel of land owned by the City of Miami Beach in its proprietary, and not governmental, capacity, said parcel of land being a portion of a tract reserved by the City of Miami Beach when it conveyed the remaining portion thereof to the Greater Miami Hebrew Academy; and WHEREAS, the City Council of the City of Miami Beach, Florida, deems that said proposed structure and menorah will enhance the scenic and aesthetic qualities of the area and will be a source of inspiration and religious meditation for those who desire to avail themselves of the benefits thereof; and WHEREAS, the City Council of the City of Miami Beach, Florida, deems it to be in the best interests of the citizens and residents of the City of Miami Beach that said request be granted; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that leave, license, and permit is hereby granted to the Greater Miami Hebrew Academy to construct and maintain said menorah on said described parcel of land on the express condition and provided, however, that the construction and maintenance of said menorah will not in any way interfere with any existing public utilities, and that the said menorah will be maintained in proper and suitable manner, and that the leave, license, and permit hereby granted shall not create any vested interest in the Greater Miami Hebrew Academy to maintain the same or to any right, title, interest or claim in and to the parcel of land involved and that the leave, license, and permit hereby granted shall be subject at all times to the revocation of the City Council.
