13814 RESOLUTION NO. 13814 RESOLUTION AUTHORIZING EXECUTI.ON AND DELIVERY OF GRANTS OF EASEMENT TO STATE OF FLORIDA DEPARTMENT OF TRANSPORTATION IN CONNECTION WITH FIFTH STREET WIDENING. WHEREAS, the State of Florida Department of Transportation has requested the City Council of the City of Miami Beach, Florida, to execute and deliver to it, in connection with the widening of Fifth Street, Grants of Easement for the construction of a drainage outfall ; said Grants of Easement to provide as follows : "PARCEL NO. 800 . 1 SECTION 87060---2510 A 15. 00 foot strip of land running through and across Lots 46 and 47 of PLAT OF LOTS 43 to 50 INCLUSIVE , BLOCK 111, OCEAN BEACH ADDITION NO. 3, according to the Plat thereof, recorded in Plat Book 14 at Page 70 of the Public Records of Dade County, Florida, said strip of land lying 7. 5 feet on each side of the following described centerline : Commence at the Northwest corner of Section 3 , Township 54 South, Range 42 East, Dade County, Florida; thence run Southerly along the West line of said Section 3 for a distance of 2945. 19 feet to a point of intersection with the Base Line of Fifth Street as said Base Line of Fifth Street is shown on the Fifth Street Right of Way Map according to the plat thereof recorded in Road Plat Book 83 at Page 72 of the Public Records of Dade County, Florida; thence run N 89°02 ' 12" E along said Base Line of Fifth Street for a distance of 461. 90 feet; thence run S 59°02 ' 12" W for a distance of 241. 2 feet; thence run N 30°57 ' 48" W for a distance of 7. 2 feet; thence run S 51° 57 ' 19" W for a distance of 25. 7 feet to a point of intersection with the Southwesterly Right of Way Line of Alton Road and the Point of Beginning of the following described centerline; thence continue S 51° 57 ' 19" W for a distance of 175. 4 feet; thence ran S 63°53 ' 53" W for a distance of 131 . 0 feet to the waters of Biscayne Bay and the END of the herein described centerline . TO DAVE AND TO HOLD the same unto the second party, its succes- sors and assigns together with immunity unto the second party, its successors or assigns from all claims for damage, if any, arising from or growing out of such construction and/or maintenance to the lands, if any, owned by the first party, lying adjacent or conti- guous to the lands hereinabove described and the party of the first part will defend the title to said lands against all persons claiming by, through or under said party of the first part. " As well as, An additional Easement in connection therewith for the purpose of clearing, excavating, and removing soil , clay and other material, for construction of a sub-grade drainage outfall upon the land des- cribed in the Construction Plans of said State Department of Trans- portation as Parcel No. 700. 1, Section 87060-2510, and being locat- ed generally along the West line of Section 3, Township 54 South, Range 42 East, Dade County, Florida, and commencing at the North- west corner of said Section 3; and WHEREAS, appropriate Grants of Easement have been duly prepared, and have been approved as to form by the City Attorney; and WHEREAS , the City Council of the City of Miami Beach, Florida, deems it to be in the best interests of the City of Miami Beach, and its residents that said Easements be granted; NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the Mayor and the City -1- OFFICE OF CITY ATTORNEY--1130 WASHINGTON AVENUE--MIAMI BEACH, FLORIDA 33139 , - - Clerk-Finance rClerk-Finance Director be and they are hereby authorized and directed to execute said Grantsof Easement in the name and on behalf of the City of Miami Beach, Florida.
