13851 • RESOLUTION 13851 WHEREAS, on September 7, 1972, one CURTIS LEE HANKS, while working as an employee of the City, injured his head and back when the sanitation truck on which he was riding was struck by another vehicle, and WHEREAS, said employee was examined or treated by Drs. Pacheco and Davis, and WHEREAS, he suffered a permanent partial dis- ability of his body as a whole, and WHEREAS, the City Attorney has recommended to the City Council that it is in the best interest of the City to enter into a settlement under the provisions of FSS 440. 20 (10) , as amended, 1967, such settlement to be in the total amount of $700. 00; $500.00 of this amount being for the permanent partial disability to his body as a whole and all past, present or future compensation and medical benefits due Mr. Hanks and the remainder repre- senting attorney' s fee of $150. 00, and $50. 00 doctor' s examination and report, and WHEREAS, the Order of the Judge of Industrial Claims approving such settlement stipulation will not be subject to modification or review, and WHEREAS, the City Council deems it to be in the best interest of the City to enter into a final settle- ment stipulation as herein before set forth, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the City Attorney be and he is hereby authorized to enter into final settlement stipulation with CURTIS LEE HANKS and his attorney, and if said settlement is approved by a Judge of Industrial Claims, the proper officials of the City be, and they are hereby authorized and directed to comply with the Order of the Judge approving said stipu- lation.
