RESOLUTION NO. 73-13863
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, CALLING A SPECIAL
ELECTION TO FILL THE UNEXPIRED TERM OF THE
OFFICE OF COUNCILMAN, GROUP I
WHEREAS, a vacancy has arisen in the office of
Councilman in the City of Miami Beach, Florida, Group I , as a
result of the provisions of Section 99 . 012 , Florida Statutes,
1971, otherwise known as the "Resign to Run" Law; and
WHEREAS, the City Council of the City of Miami Beach
has duly determined that said vacancy should be filled by a
Special Election, as authorized under Section 28 of the Charter
of the City of Miami Beach;
NOW, THEREFORE , BE IT RESOLVED BY THE CITY COUNCIL OF
THE CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. That a Special Election is hereby called and directed
to be held in the City of Miami Beach, Florida, from
7 : 00 o' clock A.M. until 7 : 00 o 'clock P.M. on the 20th day of
February, 1973, for the purpose of electing a Councilman to fill
the unexpired term of that office of councilman designated as
Group I , the term of which expires on November 6, 1973.
SECTION 2. That the appropriate and proper Dade County election
officials shall conduct the said Special Election
hereby called, exoept for the canvassing of the returns of said
Special Election, which duty shall be performed by the City Coun-
cil. The official return sheets from each precinct shall be
furnished to the City Clerk of the City of Miami Beach as soon as
the polls are closed after said Special Election. The official
certification of the results of said Special Election shall be
made by the City Council of the City of Miami Beach.
SECTION 3. That the said voting precincts in the City for said
Special Election shall be as established by the proper
and appropriate Dade County election officials . All electors shall
vote at the polling places in the voting precincts in which the
official registration books show that the said electors reside.
Registration of persons desiring to vote in said Special Election
shall be in accordance with the general law of the State governing
voter registration.
SECTION 4. That thirty days ' notice of said Special Election shall
be given by publication in the Miami Beach Sun Reporter,
a newspaper published in the City of Miami Beach, Florida. Such
publication shall be made at least once each week for four consecu-
tive weeks during said period of thirty days .
SECTION 5. That the Notice of Election shall be substantially in
the following form:
"CITY OF MIAMI BEACH, FLORIDA
NOTICE OF SPECIAL ELECTION"
"NOTICE IS HEREBY GIVEN that a Special Election has
been called by the City Council of the City of Miami
Beach, Florida, and will be held in said City from
7 :00 o' clock A.M. until 7 : 00 o' clock P.M. on the 20th
day of February, 1973, for the purpose of electing a
Councilman to fill the unexpired term.of the office
of Councilman, Group I , City of Miami Beach, Florida;
said term expiring on November 6 , 1973 . "
Said Notice shall further set forth the several polling places in the
election precincts as established in accordance herewith, and shall
further set forth the time within which and the places where persons
desiring to register as voters in said election may so do.

SECTION 6. That the voting shall be on voting machines and that
the official ballots thereon shall be in substantially
the following form:

The ballot shall be so prepared that the names of qualified
candidates for the office to be filled shad± appears on said
ballot in alphabetical order according to surname, and that
the said ballot and its preparation shall be such so as to be
in compliance with the laws of the State of Florida with res-
pect to the use of mechanical voting machines .
SECTION 7. That absentee voters participating in said Special
Election shall be entitled to cast their ballots
in accordance with the provisions of the laws of the State of
Florida with respect to absentee voting.
SECTION 8. Any person desiring to qualify as a candidate for
the unexpired term of the office of Councilman,
Group I of the City of Miami Beach, Florida, must qualify as
such candidate not earlier than January 23, 1973 and not later
than 5 : 00 o' clock p.m. on February 6 , 1973. A qualifying fee
of Seventy five dollars ($75. 00) shall be paid to the City
Clerk of the City of Miami Beach, Florida, at the time of quali-
fying as such candidate. Said candidate shall, at the time of
his qualification as such candidate, take, sign, and subscribe
to an oath or affirmation in writing, in substantially the form
prescribed by Section 40 of the Charter of the City of Miami Beach.
SECTION 9. The candidate receiving the highest number of votes
cast in said Special Election shall be deemed to be
elected. In case two or more persons receiving an equal and high-
est number of votes , such persons shall draw lots to determine
who shall be deemed the successful candidate.

SECTION 10. That the City of Miami Beach shall pay all expenses
for conducting this Special Election and will pay
the same directly to all persons or firms , upon receipt of invoice
or statement approved by the Supervisor of Elections of Dade County,
Florida.
SECTION 11. That this Resolution shall be effective immediately
upon its passage.
