73-13894 .4, i RESOLUTION NO. 73-13894 A RESOLUTION AUTHORIZING AGREEMENT WITH J. FREDERIC BLITSTEIN FOR STUDY, REPORT, AND RECOMMENDATIONS CONCERNING LINCOLN ROAD MALL AND SIDEWALK CAFES. WHEREAS , J. Frederic Blitstein has submitted a proposal to the City Council whereby he would be authorized and employed to complete a study originally initiated by the owners of the Lincoln Road Mall property, to determine the feasibility of side- walk cafes on Lincoln Road Mall; the feasibility of a public management corporation for the operation and management of all open space on Lincoln Road Mall; air rights; potential lease revenues to the City, coordinated advertising, maintenance and development, for a fee of $5, 800. 00 and, WHEREAS , the Acting City Manager has recommended that such an agreement be entered into, WHEREAS, City Council deems it to be in the best interest of the City that said recommendation of the Acting City Manager be accepted. THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the said J. Frederic Blitstein be and he is hereby authorized and employed to make his report, study and recommendations, all as set forth in his letter to the City Manager dated January 11, 1973 and the attachment thereto denominated as "Sidewalk Cafe Proposal" and as set forth in the first paragraph hereof, at an agreed fee of $5, 800. 00 payable from available Contingency Funds and, BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA, that the proper finance officers , be and are hereby authorized and directed to make the disbursement hereby appropriated and authorized. Using the first block (Washington/Drexel) as the test area a ground floor plan, lrepared in conjunction with the Planning Department, which will allow for an unimpeded pedestrian flow . directly in front of the stores . In the initial stages, at least, the cafes will be located under the proposed canopies abutting the store fronts and will not be placed in any of the center or other public Mall space. 3 . !recommendation in a special zoning district overlay (to he later utilized for the entire Mall development) for type of cafe to be permitted, size, numberrolock and architectural relationship to existing shops fronting on the ',tall. 4 . Study, in conjunction with the City' s legal office , as to the revenues produced by the cafes and the percentage dis- tribution to the City (refer to Public t•ianagement Corporation) fi 3 . Study detailing operation of cafe areas in business and tourist areas similar to that projected for the Lincoln Road '_all. (Include planning which permits cafe usage , type of lease-revenue agreement with public agency, if involved) 6 . Outline of guidelines which would regulate implementation and operation of cafes on the Mall. Discussion of a board or agency (refer to Public Management Corporation) to which plans would be submitted and which would include representatives of Public ':Yorks and Planning Departments , etc. 7. A proposal for a Public Management Corporation which would function as a part of the City Manager' s office. It would have responsibility for all open space on the Mall and would • prepare and promote the needed revenue-producing projects which would defray the City' s initial capital investment costs and would generate revenues to at least make the '?all a self- liyuidating proposition. Spence: Enclosed is the outline requested by you for the completion of a combined sidewalk cafe study and Public "anagement Corporation proposal. As already discussed, we have begun t the architectural and engineering design and would like to present it along with the above mentioned work. It is t imnerativo that all work for the 'tall project be coordinated , and th` cafe study is a key th the Council' s successful acceptance R of the design package. The property owners already have indi- q cated their support for cafes and will work with the City in insuring their successful implementation. In good faith, they have included in the management funds already being paid to my company, monies with which to begin the study. The additional $5 ,800 is needed to complete the work. Time is now a factor. The study should begin by the end of January so as to be ready for the projected middle March total package presentation date. As usual , thank you for your cooperation.
