RESOLUTION NO. 73-13958
WHEREAS, the City Council of the City of Miami Beach,
Florida, deems it to be necessary for the welfare of said City
and the inhabitants thereof to acquire for public park, recrea-
tional and other appropriate public purposes, a parcel of land
generally described as Lots 1 through 12 of Block 3, SECOND OCEAN
FRONT SUBDIVISION, Plat Book 28, page 28, of the public records
of Dade County, Florida, together with a parcel of sovereignty
land in Indian Creek abutting generally Lots 2 through 7 and a
portion of Lot 8, Block 3, of said subdivision, said parcels of
land being more particularly described and set forth in the
schedule attached hereto and incorporated herein by reference,
and
WHEREAS, the owners of said parcel of land have agreed
and stipulated that the City of Miami Beach may proceed with the
acquisition of the fee simple title to said described land under
the provisions of Chapter 74, Florida Statutes, and that the City
of Miami Beach shall have the right, and the owners have agreed
that a deposit by the City of Miami Beach into the Registry of
the Court of the sum of $500, 000.00 shall be a sufficient compli-
ance with the provisions of Section 74.031 and Section 74.051,
Florida Statutes,
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that it is necessary that
the fee simple title to the above-described property be acquired
for public park, recreational and other public purposes, for
the benefit of said City and its inhabitants,and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, that the City Attorney be and he is
hereby authorized and directed to institute the necessary legal
proceedings, under the provisions of Chapter 74, Florida Statutes,
in the name of said City in the exercise of its right of eminent
domain for the condemnation of said described parcels of land for
the purposes hereinabove set forth.
