A RESOLUTION DECLARING PUBLIC EMERGENCY
AFFECTING LIFE, HEALTH AND WELFARE OF THE
COMMUNITY DUE TO RENT SPIRAL, IMPOSING A
MORATORIUM ON RENTS FOR A NINETY-DAY
PERIOD UNLESS SOONER VACATED.
WHEREAS , tenants in Miami Beach are particularly and
unexpectedly subject to spiralling rent costs due to a number
of factors beyond their control, including the recent end of •
federal rent controls, heightened inflation and very recent
and tremendous upward surge of the index-of-living costs which
affect the tenants much more than the landlord, scarcity of
local rental units due to recent building moratoriums, increased
competitiveness for existing units because of recent local con-
demning of property and eviction of other tenants, competitive-
ness for existing rental units because of a vast influx of
wealthier retirees seeking this climate and willing to pay
higher rents, the particularly larger percentage of established
residents in Miami Beach who live here on fixed incomes and
cannot afford unexpected rent increases - all have conspired
to cause suffering, terror, and financial panic to large
seyments of the population who have been innocently and sud-
denly placed in an unreasonable bargaining position vis-a-vis
their landlords - and who often are being very suddenly forced
to move because rents are higher than they can pay; and with
so many elderly citizens, the mere necessity of their moving
affects their health, and in others, lesser limits of money
available for other necessities such as food will affect their
health; and
WHEREAS , it is the finding of the City Council of the
City of Miami Beach that recent spiralling rent increases have
caused an extreme emergency that requires immediate policing;
THEREFORE, IT IS RESOLVED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, that beginning today (March 21,
1973), rents be frozen as of this date on a temporary basis not
to exceed ninety days and to be terminated earlier if there is
action of the State Legislature on these matters or of the
President of the United States .
BE IT FURTHER RESOLVED, 'that if at the end of ninety
days there is no appropriate action from the State Legislature
or Federal Government, a referendum shall be called for an amend-
ment to the Charter of the City of Miami Beach empowering the
Council to pass rent control ordinances.
Exempted are hotels, motels (excluding tenants on
yearly leases) , new construction, business or commercial space,
charitable, educational or non-profit institutions .
PASSED and ADOPTED this 21st day of March 1973 .
