A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA, REQUESTING THE STATE
LEGISLATURE TO ENACT STATEWIDE LEGISLATION
REQUIRING ALL PUBLIC OFFICIALS AND EMPLOYEES
TO MAKE FINANCIAL DISCLOSURE RELATING TO THE
EXISTENCE OF CONFLICTS OF INTEREST.
WHEREAS, various efforts have been made to adopt, by
ordinance or charter amendment, measures compelling financial
disclosure by elective and appointive municipal and county
officers, ostensibly for the purpose of disclosing conflicts
of interest; and
WHEREAS, the measures proposed lack uniformity; are
discriminatory on their face, and are not reasonably designed
to disclose activities reflecting conflicts of interest; and
WHEREAS, hasty, ill-considered and unstudied measures
are susceptible and vulnerable to legal attack on basic constitu-
tional grounds ; and
WHEREAS, limiting the application of such measures to
government at the purely local level is obviously discriminatory
and results in obvious invidious discrimination ;
NOW, THEREFORE, BE IT DULY RESOLVED BY THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, that the Legislature of the
State of Florida be and it is hereby formally requested, calling
appropriate study and analysis to enact' suitable and appropriate
legislation requiring financial disclosure reasonably calculated
to disclose conflicts of interest on the part of public officials ;
and that such legislation be made effective Statewide, and be
applicable to all public officials, whether elective or appointive,
in all levels of government, whether state, county, or municipal,
and that such legislation be made equal, uniform, and non-discriminatory
in its application ; and
BE IT FURTHER RESOLVED BY THE CITY COUNCIL OF THE CITY OF
MIAMI BEACH, FLORIDA, that copies of this resolution be transmitted
to the President of the Senate, the Speaker of the House of Repre-
sentatives, and to each member of the Dade County delegation of the
Legislature of the State of Florida.
