THIS ORDINANCE.
BE IT ORDAINED SY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1 : It shall be unlawful for any person, firm or corpora-
tion to engage in the business of operating a private
school within the City of Miami Beach, Florida, unless
such person, firm or corporation shall have first complied with all
the rules and regulations governing toilet facilities, drinking
water facilities and other health requirements pertaining to public
schools as set up by the Board of Health.
SECTION 2: It shall be unlawful for any person, firm or corpora-
tion operating a private school in the City of Miami
Beach, Florida, to employ as a principal or head
master of said private school any person who does not hold a valid
Florida graduate certificate and who has not had at least three (3 )
years of successful teaching experience in a standard public or
private school of some State. This teaching experience shall be
substantiated by three (3) recommendations as follows: (a) from
a State Superintendent of Public Instruction; (b) testimonial of
moral character, preferably from a minister of the gospel; (c)
testimonial, original or notarized copy of the original, as to teach-
ing ability and success from school officials for whom applicant
has done at least twantyifour (^A) months of teaching; and in the
event that the person or applicant has previously operated his own
private school before applying for permit or license, he shall com-
ply with the required endorsements of the State Superintendent and
testimonial as to oharaoter, and in addition shall obtain a reaom-
mendation from his local Superintendent of Public Instruction,
SECTION 3: Any person or head easter operating a private school
in the City of Miami Beach, Florida, shall be the local
Resident Manager of said private school.
SECTION 4: It shall be unlawful for any person, firm or corpora.
tion operating a private school in the City of Miami
Beach, Florida, to employ as a teacher in said private
school any person who does not hold a valid Florida teaching certifi-
cate or its equivalent.
SECTION 5: It shall be unlawful for any person, firm or corporation
operating a private school in the City of Miami Beach,
Florida, to operate said school unless the said private
school shall meet the accredited requirements of the State Department
of Public Instruction and shall be listed by the State Department of
Public Instruction as an accredited school by the end of its second
year of existence.
SECTION 6: It shall be unlawful for any person, firm or oorporation
to advertise any private school as an accredited school.

State Department of Public Instruction.
SECTION 7 : It shall be unlawful for any person, firs or corpora-
tion operating a private school in the City of Miami
Beach, Florida, or for any agent, servant or employee
to offer any fees, bonuses, either monetary or otherwise, to any
apartment or hotel owner or the servants, agents, or employees of
any apartment or hotel owner, as an inducement for that said per-
son to solicit pupils for the said private sehool.
WiCTIOVi 6: The provisions of this ordinanoo shall be effective
on any private schools beginning business after its
effective date and all private schools in existence
on the effective date of this ordinance shall meet the requirements
of this ordinance on or before September let, A. D. 1940.
SECTION 9: Whoever shall violate any of the provisions of this
ordinance shall upon conviction thereof be punished
by a fine not to exceed One Hundred ($100.00) Dollars,
or by imprisonment not to exceed sixty (60) days, or by both such
fine and imprisonment, and shall further be liable to having the
said license to operate as a private school revoked. Each day
that the violation is permitted to exist shall constitute a separate
offense.
#BONN 10: All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
SECTION 11: In the event that any section, sub-section, sentence,
clause or phrase of this ordinance shall be declared
or adjudged invalid or unconstitutional, such adjudica-
tion shall in no manner affect the other sections, sub-sections,
sentences, clauses or phrases of this ordinance, which shall be in
full force and effect as if the section, sub-section, sentence,
clause or phrase so declared or adjudged invalid or unconstitutional
was not originally a part thereof.

Council of the City of Miami Beach, Florida, has been posted by
me in three conspicuous places in the City of Miami Beach, one
of which was at the door of the City Hall in said City on the
8th day of September, A. D. , 1938 , and that said ordinance re-
mained posted for a period of at least thirty days in accordance
with the requirements of the City Charter of the said City of
Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand and
affixed the official seal of the City of Miami Beach, Florida,
on this the 10th day of October, A. D. 1938.
