AN ORDINANCE AMENDING ORDINANCE NO, 404
ENTITLED " AN ORDINANCE OF THE CITY OF
MIAMI BEACH, FLORIDA, REGARDING THE GO.

TION, TO BE A NUISANCE; PROVIDING FOR
THE ENFORCEMENT THEREOF; REPEALING ALL
ORDINANCES OR PARTS OF ORDINANCES IN CON-
FLICT THEREWITH; AND PROVIDING PENALTIES
FOR THE VIOLATION THEREOF" , PROVIDING AIL.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
Section 1: That Section 5 of Ordinance No. 404 at present read-
ing as follows :
"SECTION 5. Any person convicted of perpetrat-
ing a nuisance as described and
prohibited in the first section of
this ordinance, upon conviction thereof shall
be fined in a sum not less than One Dollar ($1.00)
nor more than One Hundred Dollars ($100.00) , to-
gether with costs of proceedings. "
be and the same is hereby amended to read as follows :
"SECTION 5. Any person convicted of perpetrat-
ing a nuisance as described and pro-
hibited in the first section of this
ordinance, upon conviction thereof shall be pun-
ishable by a fine not exceeding One Hundred Dol -
lars ( $100.00) , together with costs of proceed-
ings, or by imprisonment in the City Jail for a
period of not more than sixty days or by both
such fine and imprisonment in the discretion
of the Court.
Section 2: All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section 3: This ordinance shall be in full force and effect
after its due passage, approval and publication.

INVITATION, TO BE A NUISANCE; PROVIDING FOR THE ENFORCEMENT
THEREOF; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN
CONFLICT THEREWITH; AND PROVIDING PENALTIES FOR THE VIOLATION
THEREOF" , PROVIDING ADDITIONAL PENALTIES FOR THE VIOLATION THEREOF",
having been passed and adopted by the City Council of the City of
Miami Beach, Florida, has beezposted by me in three conspicuous
places in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 8th day of December, A. D. ,
1938, and that said ordinance remained posted for a period of at
least thirty days in accordance with the requirements of the City
Charter of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand
and affixed the official seal of the City of Miami Beach, Florida,
on this the 30th day of January, A. D. , 1939.
