A RESOLUTION OF THE CITY COMMISSION OF MIAMI
BEACH, FLORIDA, AUTHORIZING THE ABANDONMENT OF
A PORTION OF THE EAST-WEST ALLEY IN BLOCK 12
OF BISCAYNE POINT, ACCORDING TO THE PLAT
THEREOF AS RECORDED IN PLAT BOOK 14, PAGE 35
OF THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA,
AND AUTHORIZING EXECUTION AND DELIVERY OF A
QUIT-CLAIM DEED TO ONE HALF OF SAID ABANDONED
REAL PROPERTY TO THE ADJOINING PROPERTY
OWNERS .
WHEREAS , the Plat of Biscayne Point was approved and
recorded in Plat Book 14 , at Page 35 of the Public Records of Dade
County , Florida , in 1925 , and
WHEREAS , said Plat , in Block 12 of said Subdivision ,
reflects an unmarked and unnamed street or alley , 20 feet in
width, running east and west , bounded on the north by Lots 1
through 5, inclusive , and bounded on the south by lots 6 through
15, inclusive , and A through E , inclusive , and
WHEREAS , the owners of Lots 14 and 15 in Block 12 of
said subdivision petitioned the City Commission of the City of
Miami Beach to abandon , vacate , surrender and disclaim any and all
right , title and interest in and to that portion of said street or
alley , adjoining and immediately north of said Lots 14 and 15 ,
and
WHEREAS , there is no dedication of said street or alley
on the said Plat or recorded on the Public Records of Dade County,
Florida separate from said Plat , and
WHEREAS , in the 58 years since the recording of said
Plat , the City of Miami Beach has not at any time constructed ,
paved , maintained or repaired said street or alley, and that the
adjoining property owners have landscaped , fenced , built upon and
have otherwise treated and used said street or alley as though it
were their own property , and
WHEREAS , the abandonment , vacation , disclaimer , and
surrender of the subject alley property is deemed to be in the
best interest of the City of Miami Beach and its citizens ; and
WHEREAS , the Public Works Department of the City of
Miami Beach recommends that the City retain a 10 foot utility
easement , 5 feet on either side of the said center line of the
subject street or alley ;
NOW, THEREFORE , BE IT DULY RESOLVED BY THE CITY COMMIS-
SION OF THE CITY OF MIAMI BEACH, FLORIDA, that the City of Miami
Beach does hereby surrender , abandon , vacate , and disclaim all of
its right , title and interest in and to that portion of the
East-West alley, or the extension thereof , in Block 12, of
BISCAYNE POINT, according to the Plat thereof recorded in Plat
Book 14 , at Page 35 of the Public Records of Dade County , Florida ,
adjoining and immediately North of Lots 14 and 15, in said Block
12 , being approximately 60 feet by 20 feet , and the Mayor and City
Clerk are hereby authorized to execute a Quit Claim Deed to the
adjoining property owners to the South half of said abandoned
property , more particularly described as follows :
That portion of the unnamed East-West street
or alley , or the extension of said alley ,
running West , in Block 12 of BISCAYNE POINT,
according to the Plat thereof recorded in Plat
Book 14 at Page 35 of the Public Records of
Dade County, Florida , described as follows :
Bounded on the South by the North lines of
Lots 14 and 15 of said Block 12 ; bounded on
the West by the extension of the West line of
said Lot 15, running North ten feet ; bounded
on the North by the center line of the unnamed
East-West street or alley, or the extension of
the center line of said street or alley , of
said Block 12 ; and bounded on the East by the
extension of the East line of said Lot 14
running North ten feet ; being approximately 60
feet by 10 feet .

THIS QUIT-CLAIM DEED, made this 13th day of
July , 1983 , between the CITY OF MIArMI BEACH, a municipal
corporation in Dade County, Florida, Grantor, and SAMUEL PALENCIA
and SABUD PALENCIA, his wife, whose post office address is 1345
Cleveland Road, Miami Beach, Florida 33141 , Grantees ,
WITNESSETH, that said Grantor, for and in consideration
of the sum of Ten ($10. 00) Dollars and ..other good and valuable
consideration to said Grantor in hand paid by said Grantees , the
receipt whereof is hereby acknowledged, does hereby remise,
release and quit-claim to said Grantees, and Grantees ' heirs and
assigns forever, all of the right, title, interest, claim and
demand which said Grantor has in and to the following described
land, situate, lying and being in Dade County, Florida to-wit :
That portion of the unnamed East-West street or alley,
or the extension of said alley, running West, in Block 12 of
BISCAYNE POINT, according to the Plat thereof recorded in Plat
Book 14 , at Page 35 of the Public Records of Dade County, Florida,
described as follows : Bounded on the South by the North lines of
Lots 14 and 15 of said Block 12; bounded on the West by the
extension of the West line of said Lot 15, running North ten feet;
bounded or the North by the center line of the unnamed East-West
street or alley, or the extension of the said center line of said
street or alley, of said Block 12 ; and bounded on the East by the
extension of the East line of said Lot 14 running North ten feet;
being approximately 60 feet by 10 feet. •
SUBJECT, HOWEVER, to the City of Miami Beach. Florida
retaining therein, a 10 ' utility easement consisting of 5 ' on
either side of the center line of said alley.
TO dAVE AND TO HOLD the same together with all the
estate and rights of Grantor in such property.
