• ORDINANCE NO. 566 AN ORDINANCE OF THE CITY OF MIAMI BEACH PROHIBITING THE GOING UPON THE SIDEWALKS, STREETS AND HIGHWAYS OF THE CITY OF MIAMI BEACH, FLORIDA, IN A BATHING SUIT UNLESS SUCH WEARER SHALL ALSO WEAR ADDITIONAL CLOTHING, AND FIXING A PENALTY FOR THE VIOLATION THEREOF. WHEREAS, the going upon the sidewalks, streets and other places of persons clad in bathing suits only is un- satisfactory and annoying to the general public in many ways ; that bathing suits so worn are frequently wet and spoil the clothing of those with whom they come in contact; that such bathing suits so worn often times contain sand and other material which is scattered promiscuously by such wearers; that such wearers of bathing suits frequently have upon their bodies, for the protection or cure of sun- burn, wet and sticky salves and lotions which rub off upon the clothing and property of others; and that in many other ways the wearing of bathing suits upon the public streets and in public places is unsightly, distasteful, unsatisfactory and annoying to others; BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH, FLORIDA: SECTION 1. It shall be unlawful for any person to go upon the public sidewalks, streets or high- ways of the City of Miami Beach, Florida, clothed in a bathing suit unless such person and bathing suit is covered with a cloak, robe or other covering extending from the shoulders to the knees. SECTION 2. Any person violating any provision of this ordinance shall be punished by a fine not exceeding twenty-five dollars ($25.00) or imprisonment in the city jail not exceeding five (5) days or both within the discretion of the Court. SECTION 3. All ordinances and parts of ordinances in con- flict herewith are hereby repealed. PASSED AND ADOPTED this 16th day of November, A. D. , 1939. TOMLINSON, City Clerk in and for the City of Miami Beach, Florida, do hereby certify that Ordinance No. 566 entitled "AN ORDINANCE OF THE CITY OF MIAMI BEACH PRO- HIBITING THE GOING UPON THE SIDEWALKS, STREETS AND HIGHWAYS OF THE CITY OF MIAMI BEACH, FLORIDA, IN A BATHING SUIT UNLESS SUCH WEARER SHALL ALSO WEAR ADDITIONAL CLOTHING, AND FIXING A PENALTY FOR THE VIOLATION THEREOF" , having been passed and adopted by the City Council of the City of Miami Beach, Florida, has been posted by me in three conspicuous places in the City of Miami Beach, one of which was at the door of the City Hall in said City on the 17th day of November, A. D. , 1939, and that said ordinance remained posted for a period of at least thirty days in accordance with the requirements of the City Charter of the said City of Miami Beach.
