AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, REGULATING
THE ERECTION AND INSTALLATION OF NUMERICAL
SIGNS OR PRICES ADVERTISING THE RATES OF
HOTELS OR APARTMENT HOUSES, AND FIXING THE
PENALTY FOR VIOLATION OF THE PROVISIONS
HEREOF.
WHEREAS, the erection, installation, or display of numerical
figures, price signs, sign boards, banners either painted, electrical,
or neon, advertising the rates of hotels or apartment houses on Miami
Beach is contrary to public policy in that such a practice tends to
lessen the dignity of Miami Beach as a resort, inviting tourists and
visitors to sojourn on Miami Beach for their pleasure, health and well-
being; and
WHEREAS, the posting, erecting, installing or placing, price signs
on hotels, or apartment houses on Miami Beach leads to vicious practices
and unfair methods on the part of owners, managers, or other persons in
charge of hotels and apartment houses so that tourists, visitors, and
other persons coming to Miami Beach become victims of deception, and fraud,
and are generally made to feel that discrimination is practised upon them
by hotels, or apartment houses on Miami Beach, and
WHEREAS the posting erecting, and placing, of price signs on hotels
and apartments in Miami Beach creates a false impression of cheapness,
actually non-existent on Muni Beach, in that such signs are intended to
entice and lure unwary tourists and visitors to enter hotels and apart-
ments only to find that prices advertised by the signs are not the true
prices charged for such rooms and apartments, and
WHEREAS the installation, erection, placing or painting of signs
upon hotels and apartments in Miami Beach constitute unfair practices and
are contrary to the ethics of better business bureaus, and constitute a
nuisance to the industry of hotels and apartment houses, as well as to
visitors, tourists and the public in general:
NOW, THEREFORE, MAY IT BE ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA:
SECTION 1. It shall be unlawful to erect, install, display, paint or
place any signboard, billboard, banner, either painted,
electrical or neon advertising the rates of any hotel or apartment house
in the City of Miami Beach.
SECTION 2. It shall be unlawful to paint or stencil on any hotel or
apartment house on Miami Beach any price, figure, or word
designating the rental, price or cost of any room or apartment for any
time whatsoever.
SECTION 3. Any person, firm or corporation whether the owner of any
hotel or apartment house or the manager or anyone in charge
who shall violate this ordinance shall be punished by a fine of not less
than $25.00 or no more than $500.00 or be imprisoned for not more than
90 days with or without hard labor or both in the discretion of the court.
SECTION 4. In the event any section, sub-section, sentence, clause or
phrase of this ordinance shall be declared or adjudged in-
valid or unconstitutional such adjudication shall in no manner effect the
other sections, sub-sections, sentences, clauses, or phrases of this ordi-
nance which shall be in full force and effect as if the section, sub-
section, sentence, clause or phrase so declared or adjudged invalid or
unconstitutional was not originally a part thereof.
SECTION 5. All ordinances or parts of ordinances in conflict herewith
or inconsistent with the provisions of this ordinance are
hereby repealed.

Ordinance No. 57L , entitled "AN ORDINANCE OF THE CITY COUNCIL
OF THE CITY OF MIAMI BEACH, FLORIDA, REGULATING THE ERECTION
AND INSTALLATION OF NUMERICAL SIGNS OR PRICES ADVERTISING THE
RATES OF HOTELS OR APARTMENT HOUSES, AND FIXING THE PENALTY
FOR VIOLATION OF THE PROVISIONS HEREOF", having been passed
and adopted by the City Council of the City of Miami Beach,
Florida, has been posted by me in three conspicuous places in
the City of Miami Beach, one of which was at the door of the
City Hall in said City on the 2nd day of May, A. D., 1940, and
that said Ordinance remained posted for a period of at least
thirty days in accordance with the requirements of the City
Charter of the said City of Miami Beach.
IN WITNESS WHEREOF I have hereunto set my hand
and affixed the official seal of the City of Miami Beach, Florida,
on this the 19th day of July, A. D., 1940.
