CIAL PERMISSION FOR SAID CONSTRUCTION IS
OBTAINED FROM THE CITY COUNCIL.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Paragraph C, under item 1 of Section 17,
entitled General Provisions, be and the same
is hereby amended to read as follows:
"c. No dock, wharf, dolphin or structure of any kind
shall be erected, constructed or reconstructed,
so as to extend into Biscayne Bay a distance
greater than twenty..five (25) feet , or so as to
extend into Indian Creek, a distance greater
than fifteen (15) feet or so as to extend into
¢ollins Canal a distance greater than three (3)
feet, or so as to extend into any other waterway
in the City of miami Beach, a distance greater
than five (5) feet, except that with special
permission of the City Council, docks, wharves,
dolphins or similar structures may extend from
a business or multiple-family lot into Biscayne
Bay a distance not greater than one hundred twenty--
five (125) feet. No part of any such dock, wharf,
dolphin or structure shall be higher than two (2)
feet above the top of the adjoining seawall or
the established grade for the seawall if none
exists.
SECTION 2: All ordinances and parts of ordinances in conflict
herewith are hereby repealed.
SECTION 3: This ordinance shall take effect immediately after
its passage and posting.

125 FEET, PROVIDED SPECIAL PERMISSION FOR SAID COSTRUCT—
ION IS OBTAINED FROM THE CITY COUNCIL ' having been passed
and adopted by the City Council of the City of Miami Beach,
Florida, has been posted by me in three conspicuous places
in the City of Miami Beach, one of which was at the door
of the City Hall in said City on the 8th day of November,
A. D. , 1940 and that said ordinance remained posted for
a period of at least thirty days in accordance with the
requirements of the City Charter of the said City of
Miami Beach.
