AN ORDINANCE AMENDING ORDINANCE NO. 402,
AS AMENDED, BEING COMMONLY KNOWN AS THE
LIQUOR ZONING ORDINANCE OF THE CITY OF
MIAMI BEACH, BY REPEALING SECTION 5 AND
AMENDING SECTION 6 THEREOF, RECLASSIFYING
CERTAIN PROPERTIES WITHIN, THE CITY OF
MIAMI BEACH UNDER THE TERMS OF SAID ORDI-
NANCE NO. 1102 AND AMENDING THE SIXTH PARA-
GRAPH IN SECTION 1, BY REDEFINING THE TERM
"SERVICE BAR".
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA:
SECTION 1: That Section 5 of Ordinance No. 1.02, be and the same is
hereby repealed.
SECTION 2: That Section 6 of said Ordinance No. 402, be and the
same is hereby amended to read as follows:
"SECTION 6. In "D" District, the sale of liquor is
prohibited except in hotels having 100
or more guest rooms, provided the exterior of the
hotel in which the business is carried on shall not
contain a store front in connection with said busi-
ness, and provided that the business so licensed
shall onlbe entered from within the building, or
in Clubs. "
SECTION 3: That the boundaries of Districts "D" and "G", as re-
ferred to in Section 2 of said Ordinance No. 14.02,
and as shown on the map attached to said Ordinance
No. 402, be and the same is hereby amended so as to change the
classification of Block 1, Block 10, Lots 1 to 7, inclusive, in
Block 2 and Lots 1 to 7, inclusive, in Block 9 of Harding Town«
Town-
site, as same is shown recorded in Plat Book 34. at Page 4, Public
Records of Dade County, Florida, from District 'G" to istrict "D".
SECTION 4: That the boundaries of Districts "Cu and "D", as re-
ferred to in Section 2 of said Ordinance No. X02, and
as shown on the map attached to said Ordinance No. 402,
be and the same is hereby amended so as to change the classification
of all of Blocks 14-, 5 and 6 and Lots 1, 2, 3, 4, 7, $, 9 and 10, in
Block 8, all as shown in the Amended Plat Ocean Front Property of
the Miami Beach Improvement Company, as recorded in Plat Book 5 at
Pages 7 and 8, of the Public Records of Dade County, Florida, from
District "C" to District "D".
SECTION : That the sixth
5 paragraph of section 1 of said Ordinance
No. 402, be and the same is hereby amended to read as
follows:
"The term "Service Bar" as used in this ordinance shall
mean a bar or counter used in connection with the
operation of a bona fide restaurant, situated in the kitchen or
some room where guests are not allowed to enter, but not situated
within the room or that portion of said bona fide restaurant wherein
food is served to guests, whereon drinks are prepared solely for the
purpose of service to and consumption by guests of said restaurant,
seated at tables within the room or portion of said restaurant
wherein food is served to said guests. "
SECTION 6: All ordinances and parts of Ordinances in conflict here-
with be and the same are hereby repealed.

NO. )4-02, AS AMENDED, BEING COMMONLY KNOWN AS THE LIQUOR
ZONING ORDINANCE OF THE CITY OF MIAMI BEACH, BY REPEALING
SECTION 5 AND AMENDING SECTION 6 THEREOF, RECLASSIFYING
CERTAIN PROPERTIES WITHIN THE CITY OF MIA-iI BEACH UNDER
THE TERMS OF SAID ORDINANCE NO. 402 AND AMENDING THE SIXTH
PARAGRAPH IN SECTION 1, BY REDEFINING THE TERM "SERVICE
BAR", having been passed and adopted by the City Council of
the City of Miami Beach, Florida, has been posted by me in
three conspicuous places in the City of Miami Beach, one
of which was at the door of the City Hall in said City on
the 19th day of December, A. D. , 1940, and that said ord-
inance remained posted for a period of at least thirty days
in accorfa,nce with the requirements of the City Charter of
the said City of Miami Beach.
