AN ORDINANCE OF THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA, AMENDING SEC-
TIONS 4 AND 8 OF ORDINANCE NO. 520, PASSED
AND ADOPTED AUGUST 3, 1938, BEING AN ORDI-
NANCE OF THE CITY COUNCIL OF THE CITY OF
MIAMI BEACH, FLORIDA, PROVIDING FOR A GENERAL
ELECTION IN SAID CITY, TO BE HELD ON THE FIRST
TUESDAY IN JUNE, A. D., 1939, AND BIENNIALLY
THEREAFTER, SETTING FORTH THE OFFICERS OF
SAID CITY TO BE ELECTED AT SAID ELECTION, PRO-
VIDING FOR REGISTRATION THEREFOR; PROVIDING
THAT ALL PREVIOUS REGISTRATIONS BE DECLARED
NULL AND VOID, AND PROVIDING THE TIME, MANNER
AND PLACE OF HOLDING SUCH ELECTIONS; RE-DIVID-
ING THE CITY INTO VOTING PRECINCTS OR ELEC-
TION DISTRICTS TO CONFORM WITH THE REQUIRE-
MENTS OF CHAPTER 17899. LAWS OF FLORIDA, ACTS
OF 1937, AND PROVIDING FOR THE CLOSING OF
THE CITY REGISTRATION BOOKS PURSUANT TO PRO-
VISIONS OF CHAPTER 19528, LAWS OF FLORIDA,
ACTS OF 1939.
WHEREAS, it appears from the raturns of the last general
•lection that the number of voters participating in several election
districts or precincts of the City of Miami Beach, exceeded one thou-
sand,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF MIAMI BEACH, FLORIDA3
Section 1. That Section 4 of Ordinance No. 520, passed and adopted
on August 3rd, 1938, be and the same is hereby amended
to read as follows :
"Section 4. That for the purpose of holding and conducting
such General Elections, the City of Miami Beach,
Florida, is hereby re-divided into voting pre-
cincts or election districts as follows:
PRECINCT NO. 24.
Bounded on the North by the north city limits line of the City
of Miami Beach, which is the north line of 87th Terrace; bounded
on the South by a line running from the West line of the City of
Miami Beach east along the center line of the 79th Street Cause-
way to the center line of Everglades Concourse, thence east
along the center line of Everglades Concourse to the center line
of 71st Street, thence easterly along the center line of 71st
Street to the Atlantic Ocean; bounded on the East by the Atlantic
Ocean; bounded on the West by the west city limits line of the
City of Miami Beach.
PRECINCT NO. 25.
Bounded on the North by a line running from the west line of the
City of Miami Beach east along the center line of the 79th Street
Causeway to the center line of Everglades Concourse, thence east
along the center line of Everglades Concourse to the center line
of 71st Street, thence Easterly along the center line of 71st
Street to the Atlantic Ocean; bounded on the South by the center
line of West 51st Street produced east to the Atlantic Ocean and
west to the west city limits line of the City of Miami Beach, this
line being further described as the south line of County Commission
District No. 2; bounded on the East by the Atlantic Ocean; bounded
on the West by the west city limits line of the City of Miami
Beach.
PRECINCT N0. 28.
Bounded on the North by the center line of West 51st Street,
in the City of Miami Beach and the center line of West 51st
Street produced east to the Atlantic Ocean and west to the
west city limits line of the City of Miami Beach; bounded on
the South by a line running west from the Atlantic Ocean
along the center line of 34th Street to the east shore line
of Indian Creek, thence northwesterly across Indian Creek to
the center line of West 34th Street produced east1to the west
shore line of Indian Creek, thence along the center line of
West 34th Street produced east and the center line of West 34th
Street produced west to the center line of Biscayne Waterway,
thence westerly along the center line of Biscayne Waterway to
the east shore line of Biscayne Bay, thence due west to the west
city limits of the City of Miami Beach; bounded on the East by
the Atlantic Ocean; bounded on the West by the west city limits
line of the City of Miami Beach.
PRECINCT NO. 27.
Bounded on the North by a line running west from the Atlantic
Ocean along the center line of 34th Street, to the east shore
line of Indian Creek, thence northwesterly across Indian Creek
to the center line of West 34th Street produced east to the
west shore line of Indian Creek, thence along the center line
of West 34th Street produced east —en th a ter line of West
and the center line of West 34th Street produced
west to the center line of Biscayne Waterway, thence westerly
along the center line of Biscayne Waterway to the east shore
line of Biscayne Bay, thence due west to the west city limits
line of the City of Miami Beach; bounded on the south by a line
running from the Atlantic Ocean northwesterly along the center
line of 23rd Street and the center line of 23rd Street produced
northwesterly to the center line of Dade Boulevard, thence
southwesterly along the center line of Dade Boulevard to the
east shore line of Biscayne Bay, thence south along the east
shore line of Biscayne Bay to the center line of 14th Street,
thence northwester1y along a line running from the center line
of 14th Street and Biscayne Bay to a point on the west city
limits line of the City of Miami Beach 1500 feet southwesterly
from the intersection of the west city limits line of the City
of Miami Beach and the center line of the Venetian Causeway;
bounded on the East by the Atlantic Ocean; bounded on the West
by the west city limits line of Miami Beach.
PRECINCT NO. 28.
Bounded on the North by a line running from the Atlantic Ocean
northwesterly along the center line of 23rd Street, and the
center line of 23rd Street produced northwesterly to the center
line of Dade Boulevard, thence southwesterly aling the center
line of Dade Boulevard to the east shore line of Biscayne Bay;
bounded on the south by a line running from the Atlantic Ocean
westerly along the center line of 15th Street produced east
and the center line of 15th Street to the center line of Bay
Road, thence south along the center line of Bay Road to the
center line of 14th Street, thence west along the center line
of 14th Street to the east shore line of Biscayne Bay; bounded
on the East by the Atlantic Ocean; bounded on the West by Bis-
cayne Bay.
PRECINCT NO. 29.
Bounded on the North by a line running from the Atlantic Ocean
westerly along the center line of 15th Street produced east add
the center line of 15th Street to the center line of Bay Road,
thence south along the center line of Bay Road to the center
line of 14th Street, thence west along the center line of 14th
Street to the east shore line of Biscayne Bay; bounded on the
South by a line running from the Atlantic Ocean west along the
center line of 11th Street produced east and the center line
of 11th Street to the center line of Meridian Avenue, thence
south along the center line of Meridian Avenue to the center
line of 10th Street, thence west along the center line of
10th Street to Biscayne Bay; bounded on the East by the Atlan-
tic Ocean; bounded on the West by Biscayne Bay.
PRECINCT NO. 30.
Bounded on the North by a line running from the Atlantic Ocean
west along the center line of 11th Street, and the center line
of 11th Street produced east to the center line of Meridian
Avenue, thence south along the center line of Meridian Avenue
to the center line of 10th Street, thence west along the center
line of 10th Street to Biscayne Bay; bounded on the South by
a line running from the Atlantic Ocean west along the center
line of 7th Street produced east and the center line of 7th
Street to the centerline of Alton Road, thence south along the
center line of Alton Road to the center line of 6th Street,
thence west along the center line of 6th Street and the center
line of 6th Street produced west to the east share line of
Biscayne Bay; bounded on the East by the Atlantic Ocean; bounded
on the West by Biscayne Bay.
PRECINCT NO. 31.
Bounded on the North by a line running from the Atlantic Ocean
west along the center line of 7th Street produced east, and the
center line of 7th Street to the center line of Alton Road,
thence south along the center line of Alton Road to the center
line of 6th Street, thence west along the center line of 6th
Street and the center line of 6th Street produced west to the
east shore line of Biscayne Bay, thence north along the east
shore line of Biscayne Bay to the center line of 14th Street;
thence westerly along a line to a point on the west city limits
line of the City of Miami Beach which is 1500 feet southwester.

shore line of Biscayne Bay to the center line of the County
Causeway also described as the center line of 5th Street, in
the City of Miami Beach, thence westerly along the center line
of the County Causeway to the west city limits line of Miami
Beach; bounded on the East by the Atlantic Ocean; bounded on
the West by the west city limits line of the City of Miami Beach.
PRECINCT NO. 32.
Bounded on the North by a line running from the Atlantic Ocean
west along the center line of 3rd Street produced east, and
the center line of 3rd Street to the center line of Alton Road,
thence along the center line of Alton Road to its intersection
with the south line, produced northeasterly, of Lot 32, Block
lii, Ocean Beach Addition No. 3, as recorded in the Public
Records of Dade County, Florida, in Plat Book 2 at Page 81,
thence southwesterly along the south line of said Lot 32 pro-
duced northeasterly, and the south line of said Lot 32 to the
east shore line of Biscayne Bay, thence northwesterly along
the east shore line of Biscayne Bay to the center line of the
County Causeway also described as the center line of 5th Street,
in the City of Miami Beach, thence westerly along the center
line of the County Causeway to the west city limits line of
the City of Miami Beach; bounded on the South by the center
line of Bears Cut; bounded on the East by the Atlantic Ocean;
bounded on the West by the west city limits line of the City
of Miami Beach.
Prior to the holding of each General Election, the City
Council shall b7 resolution designate a polling place in
each of the above described voting precincts or election districts
and thereupon the Mayor or Acting Mayor shall issue his proclama-
tion giving notice of such General Election to be held in the
City of Miami Beach, which proclamation shall contain a list of
the officers to be voted for and the other questions to be voted
upon, if any; the polling places; the time for opening and closing
the polls, and such notice or proclamation shall be published once
a week for a period of four consecutive weeks next preceding such
election, in a newspaper published in the City of Miami Beach,
Florida, and shall be posted for a period of thirty days in three
conspicuous places in the City of Miami Beach, Florida, and the
official ballot to be used at such general elections shall be pre-
pared by the City Council in the manner provided by the State law.
At least twenty days prior to the holding of each General
Election the City Council shall, by resolution, appoint and
designate, in accordance with provisions of the law, Inspectors and
Clerks for the purpose of carrying on and conducting such general
elections and shall cause the names of such Inspectors and Clerks
to be published in a newspaper, published in the City of Miami Beach,
for at least fifteen days before the day of holding said election. "
Section 2, That Section 8 of Ordinance No. 520, passed and adopted
on August 3rd, 1938, be and the same is hereby amended
to read as follows :
"SECTION 8: The City Clerk shall open and keep open the Registra-
tion Books of the City of Miami Beach, Florida, at
all times between ten o'clock A. M. and four o'clock P. M., Sundays,
holidays and half holidays excepted, except that said Registration
Books shall be closed for a period of thirty days immediately pre-
ceding the day in each year in which said election shall be held,
and remain closed until the day after said election, for the pur-
pose of registering those who are qualified to register, but
nothing herein provided shall prohibit him registering such per-
sons at any other hour during the days when said books may be
kept open in accord herewith, and he is hereby empowered and
required to administer to all persons who may desire to register
an oath that they are qualified to register and vote under the
Constitution and Laws of the State of Florida and the Charter of
the City of Miami Beach, Florida, and no persons shall be allowed
to register without such oath."
Section 3. All Ordinances and parts of Ordinances in conflict here-
with are hereby repealed.
Section 4. WHEREAS an emergency exists and the welfare of said
City is imperiled and it is necessary for the welfare
of said City that this Ordinance be immediately in force and effect,
this Ordinance shall be given three readings at one session and be-
come immediately in full force and effect.

April, A. D. , 1941, and that said Ordinance remained posted for
a period of at least thirty days in accordance with the require-
ments of the City Charter of the said City of Miami Beach.
