A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MIAMI BEACH
FLORIDA, CONFIRMING A RESOLUTION ORDERING HIGHWAY ILPROVEMENTXX
NO-. 1. HIGH WAY DISTRICT NO. 1, PASSED THE 5th DAY OF MARCH,
A. D. 1919, AND DIRECTING THE `CLERK TO PUBLISH NOTICE CALLING
FOR SEALED BIDS PRESCRIBING THE CONTENTS OF SAID NOTICE, TO-
GETHER WITH THE •CONDITIONS UPON WHICH BIDS SHALL BE RECEIVED.

RESOLUTION NO. 3.
Whereas, The City Council of the City of Miami Beach by
resolution passed and adopted on the 5th day of March, A. D. 1919,
ordered the improvement known as Highway Improvement No . 1, High-
way District No . 1, and the City Engineer under the direction of
the City Council of said City has prepared and filed with the City
Clerk of said City, plans and specifications of such improvement
and an estimate of the cost thereof, including an estimate of the
cost of the incidental expenses of said improvement , and whereas
due notice by posting and by publication in compliance with the
terms of the City Charter has been made, that the City Council
would on the 8th day of April, A. D. 1919, at the City Hall at
1 7 .30 o ' clock P . M. receive ana hear remonstrances of any and all
persons interested to the confirmation of said resolution ordering
said improvement and all remonstrances received having been heard
and considered by the City Council.
Therefore , Be It Resolved by the said City Council of Miami
Beach , Florida, that the said resolution of the said City Council
ordering said Highway Improvement No. 1, Highway District No. 1 ,
be, and the same is hereby confirmed.
Be it further resolved that the City Clerk of said City,
shall cause to be posted at the door of the City Hall in the City
of Miami Beach, Florida, and in, at least, two other public places
in said City, and to be published, at least once in a news aper
of general circulation in the said City, namely: The Miami
Metro -olis, and at least once in a newspaper of general circulation
throughout the State of Florida, namely: The Jacksonville Times
Union, a notice calling for sealed bids to be received by the City

Said notice shall state4the improvement is to be constructed, and
paid for in cash, under Section 29 of the City Charter . Any bid
covering work to be none under more than on£resolution shall be
in such form as to permit a separation to be made of the cost under
each resolution. Each proposal must be acco, ,panied by a certified
check upon a bank or trust corpany of Florida in the amount of
two and one-half (21) per cent of the amount of the bid, payable
to the City of Miami Beach, to insure the execution of a contract
to carry out therwork in accordance with the plans and specifications.
All bids will be opened and award of contract made or all bids re-
jected. After an award has been made the checks of all bidders,
other than the one to whom the contract has been awarded, shall be
returned. In default of the entering into such contract, the
certified check required to accompany such bids shall be forfeited
to the City of Miami Beach, Florida, not as a penalty, but as
liquidated damages for the delay or additional cost wich may be
incurred by the City by reason of such default. No bid will be
permitted withdrawn for any reason whatever after having been
filed with the Clerk.
