under direction of the Cit,' Council, has prepared anfiled with the
City Clerk, plans and specifications of such improvement and an esti-0 f,o,
mete of the cost thereof, including an estimate of the cost of the
incidental expenses /2 said improvement, and whereas due not ice by pub..
lication as rewired by the City Charter has been made that the City
Council would on the 19tleday of e , , , 19 'al , at the City Hall
at 7 :30 o ' clock p. m. , receive and hear the remonstrances of all
interested persons to the confirmation of said resolution ordering
said improvement, and all remonstrances received having been heard and
considered by the City Council.

Florida, That the said esolution of the City Council ordering said.

Be It ilurther Resolved, That the City Clerk cause to he published
at least once in the nrrri , a newspaper
of general circulation in the City, ef Miarri a notice ealling for
sealed bids to be received by the City Council oti. the 9th day of
August 1922, at o ' clock, p. m. for the construction
o ' eaid work, eaid notice shall state the improvement is to be constructed
and paid for in cash, under section 29 of the City Charter. .e.n,y bid
covering work to be done under mo han one resolution ital be in
such form as to permit a separation to 00 made of the cost under each
resolution. Each proposal must be accompanied by a certified chock
upon a bank or trust company of :loride in the amount of 2 per cent.
of the amount of the bid, payable to the City of Miami Beach, to insure
the execution of a contract to carry out the work in accordance with the
plans and specific' tions. All bids will be opened and award of con-
tract made or all bids rejected. After an award has been made the
checks of all bidders, other than the one to whom the contract has
been awarded, shall be returned. In default of the enterinF, into
such contract , the certified check required to accompany such bid.
shall be forfeited to the City of Miami Beach, Florida, not as a pen-
alty, but as liquidated damages for the delay or additional cost which
may be incurred by the City by reason of such d °fault. PO bid will be
permitted to be withdrawn for any reason whatever after having been
filed with the Clerk.
