AN ORDINANCE TO REGULATE CHARGES FOR
SERVICES RENDERED IN THE PROCUREMENT
OF TICKETS, RESERVATIONS OR PASSENGER
ACCOMMODATIONS ISSUED BY ANY COMMON
CARRIER INCLUDING A RAILROAD, SLEEPING
CAR COMPANY, STEAMSHIP COMPANY, AIR
LINE OR CERTIFICATED BUS LINE, AND
LIMITING THE PRICES AT WHICH SUCH
TICKETS, RESERVATIONS AND PASSENGER
ACCOMMODATIONS LAY BE SOLD; PROVIDING
THAT A VIOLATION OF SUCH ORDINANCE
SHALL BE UNLAWFUL, IMPOSING A PENALTY
FOR VIOLATION THEREOF AND PROVIDING FOR
THE POSTING OF A COPY OP SUCH ORDINANCE
IN A CONSPICUOUS PLACE ON THE PREMISES
OF ALL TRAVEL AGENCIES AND HOTELS.
WHEREAS, the public welfare is directly concerned with
the efficient operation of the various systems of public trans-
portation serving the City of Miami Beach; and
WHEREAS, the public welfare has been directly and adverse-
ly affected by certain deleterious practices, on account of
which citizens have been mulcted by excessive so-called service
charges for the procurement of transportation and, in some in-
stances, deprived of passage on steamships, airplanes, railroad
trains, motor busses and other forms of public transportation
by an artificially created shortage of passenger space, seats
or accornodatibnS # and
WHEREAS, it is essential to the publie welfare for such
transportation services to be operated efficiently and without
interference, and to protect the public against fratd, ex-
tortion, exorbitant service charges and similar abuSesj
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF MIAMI BEACH, FLORIDA:
SECTION 1. That it shall be unlawful for any person to
require, charge or receive a fee or service
charge in excess of one dollar for the procurement on behalf
of another by purchase or otherwise, of any ticket, reservation
orfpassenger accommodation issued by any common carrier includ-
ing a railroad, sleeping car company, steamship company, air
line or certificated bus line .
SECTION 2. It shall be unlawful for any person to sell,
resell, or cause to be resold, any ticket,
reservation or passenger accommodation issued by any common
carrier including a railroad, sleeping car company, steamship
company, air line or certificated bus line, at a price in
excess of one dollar over and above the established tariff
charge for such ticket, reservation or passenger accommodation
as published and filed by any common carrier, including a rail-
road, sleeping car company, steamship company, air line or
certificated bus line .
SECTION 3. Any person violating the provisions of this
Ordinance shall be guilty of a misdemeanor
and shall, upon conviction, be punished by a fine not exceeding
one hundred dollars, or by imprisonment not exceeding ten (10)
days, or in the discretion of the Municipal Judge of the City
of Miami Beach may be punished by both such fine and imprison-
ment, and each prohibited transaction shall be deemed a separate
offense and shall be punishable accordingly'j
SECTION 4. The term "person" as used in this Ordinance
includes an officer or employee of a corpora—
tion or a member of employee of a partnership who, as such officer,
employee or member, is responsible for the act in respect of which
the violation occurs.
SECTION 5. The person responsible for the management of
each travel agency or hotel operating within
the corporate limits of the City of Miami Beach, shall pause a
copy of this Ordinance to be posted in a conspicuous place upon
the premises of the agency or hotel for th Q1nformation of patrons,
guests and members of the public at large. The City Clerk shall,
upon demand, furnish copies of the Ordinance for such purpose.
SECTION 6. If any section, paragraph, clause or provisions
of this Ordinance shall for any reason be de—
clared invalid or unconstitutional, nevertheless the remaining por-
tions of this Ordinance shall remain in full force and effect.

LINE, AND LIMITING THE PRICES AT WHICH SUCH TICKETS, RE-
SERVATIONS AND PASSENGER ACCOMMODATIONS MAY BE SOLD; PRO-
VIDING THAT A VIOLATION OF SUCH ORDINANCE SHALL BE UNLAWFUL
IMPOSING A PENALTY FOR VIOLATION THEREOF AND PROVIDING FOR
THE POSTING OF A COPY OF SUCH ORDINANCE IN A CONSPICUOUS

having been passed and adopted by the City Council of the
City of Miami Beach, Florida, has been posted by me in
three conspicuous places in the City of Miami Beach, one
of which was at the door of the City Hall in said City
on the 5th day of August, A. D. , 1942 and that said Ordinance
remained posted for a period of at least thirty days in
accordance with the requirements of the City Charter of the
said City of Miami Beach.
