THE VIOLATION OF SAID ORDINANCE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF MIAMI BEACH,
FLORIDA :
SECTION 1. It shall be unlawful for any person, firm or corpora-
tion to engage in the business of packing and/or
shipping of fruits, nuts, crystallized candies or candied fruits,
cocoanut lamps or cocoanut novelties, in the City of Miami Beach,
Florida, without first obtaining from the City Clerk of said City,
a City license for the operation of said business . Said license
ma-, be obtained as hereinafter set forth.
SECTION 2 . The fee for said license shall be the sum of Twenty-
five Dollars .
SECTION 3, Application for said license shall be made on a form
to be provided by the s aid City Clerk. Before the
issuance of the, said license, the applicant shall execute and
pest with the City of Miami Beach, Florida, a bond in the sum of
One Thousand Dollars to be approved by the City Attorney of the
City of Miami Boac ., Florida, said bond to indemnify the public
against any loss by fraud on the part of such packer and/or shipper.
Said bond shall provide in its terms that the principal, the
sureties thereon, or the Company writing said bond, shall give
the City of Miami Beach, Florida, not less than ten (10) days
written notice of the cancellation of said bond in the event of
the cancellation thereof for any reason, or that said bond has
become void for any reason. Upon the filing of a proper applica-
tion and a bond drawn in conformity with the foregoing and ap-
proved as aforesaid, and upon the payment of the fee hereinabove
provided, the City Clerk shall issue said license.
SECTION 4. In the event that any bond provided for herein shall
be cancelled or shallbecome void for any reason, the
license issued to the principal thereon shall immediately become
void and shall be cancelled and revoked.
SECTION 5. Nothing contained herein shall be construed to apply
to packers and/or shippers selling quantities or bulk
shipments to the open market or in regular wholesale or commission
merchant channels .
SECTION 6. Each day that any business mentioned herein shall be
operated without a license shall be doomed and held
to be a separate and distinct offense .
SECTION 7. Any person, firm or corporation violating any pro-
visions of this ordinance shall, upon conviction in
the Municipal Court of the City of Miami Beach, Florida, be pun-
ished by a fine not exceeding the sum of One Hundred Dollars, or
by imprisonment in the City Jail of said City of liami Beach,
Florida, for a period not exceeding thirty days, or by both such
fine and imprisonment .
SECTION 8. All ordinances and parts of ordinances in.conflict
with this ordinance are hereby repoalod and this
ordinance shall be in full force and effect upon its passage and
posting in accordance with law.
SECTION 9. Should any section, paragraph, sentence, clause, or
phrase of this ordinance be declared unconstitutional
or invalid for any reason, the remainder of said ordinance shall
not be affected thereby.

FLORIDA,BEFORE THE ISSUANCE OF A LICENSE; PROVIDING THE
TERMS AND CONDITIONS OF SAID BOND; PROVIDING FOR THE
REVOCATION OF A LICENSE ISSUED UPON THE CANCELLATION OF

Having been passed and adopted by the City Council of the
City of Miami Beach, Florida, has been posted by me in
three conspicuous places in the City of Miami Beath, one
of which was at the door of the City Hall in said City
on the loth day of July,A. D. , 1942 and that said Ordinance
remained posted for a period of at least thirty days in
accordance with the requirements of the City Charter of the
said City of Miami Beach.
IN WITNESS WHEREOF, I have hereunto set my
hand and affixed the official seal of the City of Miami Beach,
Florida, on this 4th day of November, A. D. , 1942.
