SUBJECT: Suspension of the City's Noise Ordinance Exemption
The purpose of this Letter to Commission is to update the Mayor and the City Commission that,
pursuant to the July 25th City Commission meeting, notice has been provided to Ocean Drive
business of the recent suspension of the city's noise ordinance exemption.
On August 3rd letters were hand delivered to operators by the Code Compliance Department;
these letters will also be sent via certified mail. Additionally, Constant Contact emails were sent
to all known email addresses.
Letters provided advised operators that effective August 6, 2017, for a period of four months,
they are to comply with the city's noise ordinance (Section 46-152). Furthermore, they were
informed of the penalties for non-compliance pursuant to Section 46-159.
While discussed, and a clarifying question was asked by the City Manager and a consensus
appeared to be reached among the Commissioners for Code Officers, Park Rangers and Police
to proactively issue Notice of Violations (N.O.V.), as witnesses, that discussion did not make it
into the final motion. Therefore, proactive enforcement witnessed by Code Compliance, Park
Rangers or Police cannot take place at this time. Until further notice, city employees can only
respond to a non-anonymous third party complaint. City staff will revisit this issue at the
September 13th City Commission for further clarification.
